Greg Abbott: Federal judge halts Obama’s order on immigration

A federal court blocked Monday an executive order by President Barack Obama that would have granted relief from deportation to millions of unauthorized immigrants.

Texas Governor Greg Abbott announced the ruling just after 10:15 p.m. Monday night. Abbott filed the suit on Dec. 3 while he was still the state’s attorney general, leading what would become a 26-state coalition opposed to Obama’s order.

The ruling, made by federal judge Andrew S. Hanen of the federal district court in Brownsville, prevents all applicable agencies from implementing any expansions to the Deferred Action for Childhood Arrivals program.

The extended program, known as Deferred Action for Parents of Americans and Lawful Permanent Residents, aimed to protect from deportation about four million immigrants who are the parents of U.S. citizens and legal residents. It would also allow them to work legally in the country.

An additional million unauthorized immigrants would have also been shielded through other parts of the plan.

Obama had said the program would not constitute a path to citizenship.

The ruling states the injunction will remain in place until a trial before the U.S. Fifth Court of Appeals or if the Obama administration successfully argues otherwise.

The injunction comes two days before applications for consideration to the program could have been filed with U.S. Citizenship and Immigration Services.

It's a start.. Hopefully the 5th circuit upholds the injunction.

I am surprised they found a judge that could exercise common sense. Thank God there are still sane people in our judicial system.

My thoughts as well

Hopefully this judge is not in the minority when it comes to Obamas power grab.

Just in time for a DHS funding bill (H.R. 240) "amendment".

Or maybe the Senate Democrats will come to their senses and realize Obama's "Memo" are probably illegal anyway.

Considering the President is out west getting in his 18 holes and considering Congress is on a 10 day break I wonder how this info will mess up their vacations.

As for them knowing whats legal and whats not -
We have Chuck Schumer NY who stated the 3 branches of government were the President, the House and the Senate.

We have Rep. Jackson Lee telling us the Constitution is 400 years old.

I dont see the Democrats coming around any time soon.

Agreed..

I am curious what would happen if this order is upheld all the way to scotus. Would Obama comply with the ruling or do we think he would make another effort to back door it?

Why can't the gov just do what is right and just close the borders already?

The concept of our gov even CONSIDERING voting about giving another multi billion dollar handout to illegal aliens has so many damn things wrong with it.

I believe that he will try to do what he already stated on many occasions that he DOES NOT HAVE THE POWER TO DO.

Funny you don't hear the "I am the 99%" (lol) people saying anything about the possible millions of jobs lost if obama somehow forced this.

What about the african americans that have some of the worst unemployment numbers since the 60's.

Do these groups understand what this will do to them?

It's a long way from the SCOTUS but if it got there it wouldn't matter much what the President said.

Define closing the border and who would that closure apply to?

Generally speaking I think the focus is on what people can get for "free".

Are you talking about veto? That only works on laws created by Congress.
Now, if Congress would come up with a workable law...

I actually think its closer than we think. Appeal goes to the 5th circuit and from there to scotus. Considering the positions of both sides of this who ever looses on appeal will move it farther. i could see scotus reviewing any rulings in short order.

My main reasoning is the constitutionality of the order. Any constitutional challenges of this type (injury to separation of powers)are generally priority cases.

I would say that it would be impossible so long as both parties think they don't have to compromise coupled with the mindset of holding over the issue until the political landscape works in one parties favor.

Yeah. That was my point.

Thing is, surely the administration anticipated this.

Walls and a militarized zone along the southern border-only after that is complete-immediately begin deporting all illegal aliens from our correctional facilities.

Over 10 years of non stop quick deportation from construction sites, residences, etc.,we would be able to make it "not profitable" to break into the country.

Basically follow the laws that already exist-but to an extreme-drop the anchor baby law.
