Because the prosecutor really did not instruct the jury.

Juries go where the D.A. leads them. *ANYONE* can be indicted if the prosecutor wants it. He (and the power players in Ferguson/St. Louis County) didn't want it and it was fairly evident from the start three plus months ago and from his leading comments at the beginning of his presser tonight.

If the police get heavy handed in arresting people this will explode.
