If I caught you trespassing on my property attempting to rob me, and when I catch you, you beat me--if I don't kill you at that moment, you had better beleive I would chase you and gun you down.

If you are not robbing me or harming me, then there is no reason for me to kill you.

Currently, if I understand that the issue is, it is in the grey area of the law. Where it is both legal and illegal, hence why the DA is trying to decide if they are going to follow up with charges, and what to charge the man with. The man's lawyers are already working on a defense and seeing if they can best use the law to get their client off. Until he goes to court and loses the trial, he is innocent of all charges.

He is 80yrs old and a broken collarbone..how long is he going to give chase?,(edit) imo after one body is laying in the street its probably not time to find your keys and get in the car, why does everyone have such a hard time admitting the old fella had a momentary lapse of reason..he was pissed off and I don't blame him. Not his right to shoot anyone though once they are running away and not an immediat threat. Its the law..show me otherwise.
I hear people "well they pushed the old man down and robbed him" popular argument but not legal.

You do NOT have the right to shoot someone running down the street because they robbed you..sounds like a well informed legal argument I might hear in a kindergarten or grade school class..not legal..I dont need you to deliver justice unless your directly in peril..I have no issue with that.
