Than you, yest court ordered custody, we are divorced.

If that means he has legal custody of the child , you cannot just take him. You will be arrested for kidnapping. It's a very serious crime with stiff penalties.

If you think the father is a screw up then why did you hand over your kids so easily?

The time to take the tarts is when they're being passed around the table, I'm afraid.
You declined to do so and now you need a lawyer. That's how it is.

Odds are, if you do get custody while the pops is recovering, it'll be temporary. Happened to my ex-wife (not my kid though) - I was out of the country when she got the kids taken. The other baby-daddy got custody of his kids AFTER CPS gave him temporary custody. He said the lawyer fee was hella small due to the fact he already had temp custody...and the mother was seen as unfit.

You will need a lawyer.
