When was the Secret Service ever a department? Wiki says it began as a division of the Department of the Treasury, and there it stayed until the Homeland Security Act moved it to the DHS. Even if it was the "Department of the Secret Service," it could be placed under another department at any time by legislation like the HSA. There's no constitutional rule against realigning government agencies.
