Deaf man sues PornHub over lack of closed captions

So A man is suing PH over the lack of closed captions in their videos. As someone who works in the Marketing and Web design industry, this is becoming more and more prevalent. Just a few months ago a blind man won a judgment against Dominos Pizza for ADA compliance. The scary thing is this is something most businesses are not in compliance with and this can easily wrap up a small business and tank them as a result of fending off lawsuits and having to create ADA compliant websites.

I understand we want to create an enjoyable experience and equal the playing field for all persons no matter their disabilities but where does that end?

I think this is a slippery slope that could end up costing businesses tens of thousands of dollars creating an ADA site for a market they are not even trying to attract. I'm not saying that is the case for PH. I just don't think every business should be forced to change their website to cater to people who they might not be interested in doing business within the first place. Once again I don't think this is the case for PH but for others, it may be the case. Imagine a company that sells airplanes being forced to create an ADA compliant website for blind people.

Brink and mortar stores are totally different since they need to be ADA compliant in case you hire someone protected under ADA or you get visited. But the Website?

Can he honestly prove in a court of law that his viewing experience has been lessened because of the lack of CC?

Son has a hearing disorder, so we have closed captioning turned on. Having had a lot of experience now with it, I don't want to even begin to try to imagine captioning for a porno, but my mind is going there anyhow. They don't just do words, but you get music description and sound effects, sometimes they'll add emotional description to the words ...

Do you watch YouTube captioning? Tsunamis become salamis ... that's the relative quality he could expect too.

Yeah Tsunamis and Salamis was okay. Not as good as Naughty Taxidermists volume 8 though.

The auto-generated captioning on YouTube is awful and I'm not sure why google hasn't taken it down due to how impractical it is for the hearing impaired and Deaf community. It's good for the comical blunders though.
