I dont know what to say.

I doubt theres anything I could suggest that you haven't already thought of.

I hope you both stay strong and support each other as opposed to letting this become a source of friction.

And for those who judge the homeless, don't. Life is incredibly unpredictable.

Theres a lot of good people who have been victims to bad luck. Never know when we might be in a similar situation.

You'll be back and we'll be waiting for you.

I feel you pain and frustration. Worker's Comp is a farce. Get ready for long, long bumpy ride. It took 3 years for me to see a penny from my employer.

My advice to you, right now, apply for state disability insurance.


Yes.. I totally agree that it IS a farce.. !!!

3 years !! wow.. yes.. the long bumpy ride...a friend of mine took 3 years.. finally got over it.. but ..not only bumpy.. but down right malicious at some points.. as for the state disability insurance, I called the local Dept. of Health Services to see if they have such a thing and they said.. they did not and referred me to the .gov

just woke up ..and wanted to thank you all for the replies..

I'll do my best to keep you updated as this goes along .. so far, I just found out today that there is an advocacy group in town that assists those that are on WC...

I'm sorry to read of your plight Komodo , my heart goes out to you and your wife and although there is nothing I can do I do wish you luck and hope you can find a way to resolve your problem.

The way things are at the moment really angers me , it's always us the victims of the so called financial crisis that get kicked in the balls while those responsible get away scot free , you are not alone there are many in a similar situation through no fault of their own, keep your chin up.

Sad to hear this ..I too am in court in the morning with the bedroom tax. I got a feeling they are not gonna give a dam about my situation and ask me to leave. BUT hey I don't and never will let the # get to me. At the moment life's a bitch but still have a smile on me face.

Well, I don't know where you are, but where I am, you can access State Disability Insurance through the Unemployment Office, EDD. As long as your doctor says that you can't do your normal job, and they don't have "modified" work for you, you quality for SDI.

I've read many of your posts and you certainly don't come across as stupid, I have a feeling you will get through this glitch for that's what it is a glitch, a major glitch but a glitch nonetheless.

Many of us here on ATS have been through turmoil, be it financial, emotional or other. We argue like children sometimes, but the one thing we all know is that the good members here will ALWAYS rally around and support us in our hour of need.

Komodo,all I can offer is this...no matter what is going on,keep your spirits up. Like others have said,go to the library and log in for support from us here. God knows without this site there are a few of us would not have made it through some very difficult life situations. Secondly,although it may be hard to see now,life is giving you the opportunity to do something new,perhaps something better. Only you can know what that may be. Stay strong.

located in Oregon .. for the moment LOL

hmmmmm.. I do have a modified work release I'll defintely check them out, I have a VERY long working relationship with UO
they practically know me by first name..

Nobody should be treated this way, especially when they're sick and injured.
I really hope you get this sorted out and your lawyer is able to speed it up for you.
I can't even imagine how difficult it's been or how much extra stress it's put on you when you are already vulnerable.

God I hate the world, Good luck man, I hope you and your wife will be alright in the short term, and am positive that things will work out for you guys in the long term.

I just hope your short term problems are short lived.

Please keep your head up man, life can only get you down if you stop getting back up.


Although I been through worst ..

you words of getting back up hit me like a ton of bricks.. because ..every time the choice of staying down, was countered by a bigger choice to get back up .. it's always an internal thing ..never a external one..

I feel for you OP, your situation upsets and infuriates me.

Many employers claim to support their work force, but when that support is needed the most the employers are nowhere to be found, usually because loopholes help them escape from any form of compensation.

I hope there is some form of legal avenue you can take that doesn't break your wallet, I would hate to see your compensation get eaten away by legal fees.

As for your employers, I hope Karma gets the best of them and they fork out. I knew a co worker who was shafted by the boss after his knee ligaments were nearly torn to shreds, which was the bosses fault to start with. He didn't see a cent (funny how it works like that) but after the news of his poor treatment spread not even the bosses brothers wanted to work for him and lead to a mass exodus, and now nobody wants to work for him.

Hopefully this is goodbye for now and not forever, nobody wants to see a fellow member go off the radar. May the force be with you and I hope things turn out for the best.

I was in the same boat back in the late 90's. I lost everything, just got married, and had a baby on the way. Workers Comp is designed to frustrate you and make you crazy and stressed. It took me almost 2 years to get paid and I had a terrible injury at work, AND I had surgery to boot and they still done it to me!! I even went and met with the case workers to try and get her to see my situation but it fell on deaf ears. It is a cruel thing to have to endure, but it does get better up the way. You just have to remain strong-minded and roll with the punches, and it helps if you have family or friends to lean on a little. We're doing pretty good now, although it could be a lot better, but I'm happy any day that I wake up and get to spend time with my loved ones and enjoy the simple things in life. Just hang in there!

Why are they doing this to people ?? !! For me, I can't connect the dots but i'm sure it's do to $$$$$ but not exactly sure what are the chinks in their armor that makes them fight so hard ?/

Komodo, your situation is not unique but I sure do feel your sorrow and maybe some anger.

Over 20 years ago I suffered a sever bout of congestive heart failure, it damaged my heart to the point I should have and should get a new heart but that is very unlikely.

I can tell you we went almost 7 months without any money at all and I did have health insurance for this very reason.
We just bought our first home and 8 days later I was in the hospital for 10 days with invasive surgery and at lest 30 tests so on and so on.

It was a clear cut case of I am never ever going to work again but the insurance company had different ideas :-)

They argued with a world wide renowned heart specialist based in UWO Hospital in London Ontario.......This guy has written many peer reviewed papers in his life time.

Anyways so there we are sicker than a dog with a brand new mortgage.....(110k) and they wont pay me my dues.
We begged and borrowed funds from whom ever would lend them to us in good faith.

After 7 months we finally got a check in the mail but the problem was they made it out for the whole amount....(~14k) so being a check the government taxed the heck out of us.

We lost about 3k to taxes that we would not have lost had they just paid us monthly like they should have.
After 10 days in the hospital and just 3 days to recover my first visitor was an adjudicator from the insurance company trying her best to get me to sign a form that basically said I will work where I can possibly work........

Problem with that form is that if I ever work or even volunteer my time to any charity I loose my payments, thus my home.....
Rotten bastards they are!..........

Sorry to hear of your situation. You need some good legal advice because you have rights that are obviously being infringed upon. Here in Washington there is an attorney named Pat Palace who does a lot of good for us blue collar folks. I don't think he can practice in OR, but being he is in WA he most likely could advise you on who to call down there. Its a chance for hope, and all I can offer, but I think it could help you in the right direction. His law firms number is 1-253-627-3883. He does over the phone counseling for free and really likes to help the ones in need. Give him a call and good luck!
