Actually there is some confusion on this... There have been 2 court rulings, one went against the government, the other ruled in favor of the government. The rulings occurred in Federal Courts, so now they will go to the Federal Appeals courts then most likely on to SCOTUS.

It doesn't really matter how the courts find, obviously I want them to find that the government can't do it. But just the attempt is an action to preserve the continuance of government, as are many other actions taken in the past decade. Which goes back to my point, our government now exists not for the benefit of the people but rather just to preserve itself.
