What if electoral ends in a tie

Most political analyst seem to think it is a death sentence for Kerry if the electoral ends in a tie. Is it foreseeable that in fact Kerry could still pull it out if the electoral does tie.

Trying to run through all the scenarios that might be possible to cause some degree of controversy in this election and this seems to be the biggest concern.

Also what are the chances of the majority vote being overruled by the electoral this year? This question would also apply to what if the majority brings about a tie in the electoral however the majority vote favors one candidate. If this did occur would their be any chance that the following votes by the house of reps would be in correspondence with the majority vote?

Just some questions that have been rattling through my head wanted to see if anyone wanted to attempt to field them.

If there's a tie, Congress chooses the president and vice president, which could even end up in a Bush/Edwards presidency.

Since the Republicans have a solid majority in the House, there is a zero chance that Kerry would be selected for president in the event of a tied electoral college. Just wouldn't happen.

Kerry wouldn't be elected, but the Senate would likely pick Edwards as VP.

"and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President."

If the vote does go to the senate, and mixed party states abstain from voting, neither presidential candidate could get the majority. The house choice for vice-president would then become president. WOW!!! Congrats President Edwards.

The U.S. Senate would be very interesting. Kerry and Edwards can't vote for themselves, and Cheney can't break a tied vote in his own favor...

Remember the Republicans still have control over the senate. If Kerry and Edwards are not allowed to vote, then you lose two votes from the Dems side, Cheney is only the president of the Senate, so his vote would not matter. that means that the Republicans would still be in control, so don't count on a VP Edwards.

i do not believe the electorial college is bound by law to vote
as the popular vote directs

the constraints are moral, ethical, time-honored only

#2 the House of Reps. are not bound to vote as their constituens say,
they too, are only guided by tradition, opinion, ethics values, to vote
their 'conscious' & 'whats best...for the country' (in their opinion) they
are NOT bound to vote for 'whats best...for the most'

Depends on the state....some states have enacted legislation that Electoral must follow the Popular votes...but not many. It is largely tradition.

Kerry and Edwards can't vote for themselves, and Cheney can't break a tied vote in his own favor...

Interesting question, I'm not so sure they can't. After all, they are permitted to vote in the election, just as any other citizen. Is anyone aware of any actual rules regarding this?

Its an old crappy system that needs to be upgraded, It should be vote for vote. An indpendent will NEVER win with this system, They would have to win whole states, its not going to happen.
