Jail for using chalk on sidewalk? City needs to erase this error

Has your child ever written in chalk on the sidewalk?

If so, little Joey or Janie is a criminal.

So says the city of Orlando, which recently arrested — and jailed — one of the Occupy Orlando protesters for writing in chalk in front of City Hall.


Yeah stupid cops, continue to arrest big criminals like that! I mean, don't worry about Jon Corzine who stole a few billion bucks at MF Global! I mean, chalk is SERIOUS BUSINESS!

damn thats whack, i have a nice chalk picture id like to draw them...

But to be honest, if i worked in a building and there was a whole lot of grafitti in chalk on the pavement outside i may be mildly annoyed depending on what was drawn/written....its hardly a crime though!!

Imagine if he resisted and they had to shoot him for public safety.

It's funny that you did a thread on it today since they were discussing it on the radio this afternoon. The radio host was saying that the DA was most likely going to throw it out because they didn't need the bad publicity. The radio host also said that he'd be willing to pay the guy's bail.
It'll be interesting to see what comes of all of this.

If some one was defaming me by writing slanderous comments about me outside my work on the sidewalk I would be upset and want action to be taken against them in order to protect my reputation, thats fair enough isnt it??

That being said there are more important issues in the world than chalk pictures and id be willing to bet this does not apply tp suburban driveways and pavements where children draw cute little pictures because THAT would be rediculous.

Getting arrested is still over the top but looking at it from different angles helps put it into perspective.

Thank goodness we don't live in Florida because so many states have children who draw innocently on the sidewalk. With such a reptile problem, I'm surprised they can devote time to this.

id like to know on what basis they are making the arrest under. the only offense I can think of is defacing public property. But chalk is biodegradeable and you cant really be accused of littering or leaving behind dmg. What if I were to spell out my message with leafs or grass? is the oppression about the freedom of speech? or the materials used? or the property that was used for the message? if i wrote a message in the sand on a public beach with a stick that wasnt a slander or curse would I be in jail?

I can understand if someone wrote "screw obama" with fecal matter on the driveway and said they were excercising freedom of speech with biodegradable materials, that they would be wrong in doing so.
But even though both wash away in the rain and both are biodegradable,isnt one less offensive?

This is the kind of stuff only judges rule on, its just sad and not a coincidence that this problem came about in a time of crisis when people are trying to find ways to express themselfes.

Yeah dude, if you steal billions of dollars, no big deal, just say "I dunno", and you'll get off the hook. But if you whip out the chalk and draw on the sidewalk, dance at the Jefferson Memorial, or sell lemonade, you're getting handcuffed and taken away to jail. You might even get body-slammed and choked like Adam Kokesh for dancing.

I would love to see Jon Corzine or Eric Holder get body-slammed then choked by some police officers. Or maybe George Bush get struck repeatedly by a baton while officers yell "stop resisting" and haul him away for war crimes.

But we live in the real world, while the criminals are in charge of the government and can do whatever they want and get away with it, and the people have little to no power and can barely do anything without getting arrested.

I was still thinking about this as I walked out of my building 5 feet from the door two officers were ticketing a smoker for smoking to close to the door. He swore in outrage and they arrested him.
