Can't argue with that logic
... As a side note, the lawyer on that page strikes me as the kind of weasel that gives other lawyers a bad name.

If it is a claimed moving violation or a 'seatbelt" ticket. Get a copy of the dashboard camera. I was stopped three years ago and the officer said i was "riding the fog line". I was in the middle lane of a three lane wide one way, the fog line is on the right or left. He was a FREAKIN LIAR!!! I was doing NOTHING wrong but he ran my plate at the previous traffic light and followed me for 2 miles before he stopped me. I had no tags (freeman on the land stuff) and no license. The stop was illegal for him to do. HE was a total loser, thrown out!! I am still traveling today, same way.

www.youtube.com...

Watch this guy, he has a great reputation for winning in court and dealing with cops. Join this site and help out the cause to get OUR RIGHTS back!!!

ALL jurisdiction IS PRESUMED. ASK the officer if he is a public servant FIRST, before you do anything else. Give him no name, he is a security guard and NOT a "law enforcemnet officer" UNTIL or IF you acknowledge him that way. Do not GIVE HIM jurisdiction BY consent as you state. NO CONSENT, NO CONTRACT.

ALL motor vehicle code is COMMERCIAL. That is a fact.

Know your rights or you have NO RIGHTS. We the people have created government, WE possess the power and authority UNTIL we give that away by our own stupidity.

Traffic stops and infractions are what is known in law as statue laws, these laws only apply to citizens of the USA as most are citizens by their voluntary actions they are subject to the laws of both the USA and the State.

So the question is: Why?
Why do you volunteer to be subject to a private law form, all statue laws are considered private law.
Why do you have to comply to these nonsense statues that are nothing more then revenue gathering to deprive you of true freedom as originally outlined in the Constitution.

Citizens have presumed rights, we do not have total rights, they the government with the passing of the 14th Amendment has usurped all natural rights, natural rights being the common law, or what some will refer to as Gods law. Presumed rights means you need permission ie permit to do anything from driving to carrying a gun, permits are nothing more then another revenue gathering tool used by them.

So what is the solution/remedy since it is voluntary, how can you stop volunteering?
The Congress has given us the lawful means to do exactly that, they passed and approved this process prior the passing of the 14th, this was done out of necessity in order for the courts to stand on the case of voluntary servitude. So the remedy lawfully recognized in every court system and by every official including the President of the USA is corrected status. Corrected status is available through PAC, PAC has been correcting status for over 12 years with no tickets, lawsuits or any negative efforts taken against them by the establishment, again this is because it is the only lawfully way to free oneself from the private system of law and place one back into the rightful public law, the common law, the organic Constitution with full rights and no permits required.

Start your journey to true freedom at www.pacinlaw.org
And look at my threads here on ATS, simple search for PAC will bring you to my thread, freedom awaits you.

I strongly suggest you read this,www.abovetopsecret.com... there is much wrong with your statement that I will not go into on this thread but if anyone wants to learn the truth in law that is exactly what I teach. You have been misguided by some patriot group preaching what you say, however it has no true standing in court, it may work from time to time depending on the situation, but will NOT work all of the time.

PACs process is the ONLY LAWFULL way to reclaim your total rights, after the process you will never go to court again so no need to try these patriot scams that only works a handful of times. Learn the law my friends and I am always available to point you in the right direction and what law books to look up your particular questions.

Excellent point also.

I should have included that in the evidence collection section. Very vital... but hard to get some time.

Be sure to read up on your states Rules of Criminal Procedures also.

IF YOU HAVE AN AUDIO RECORDER ON YOUR PHONE, USE IT!!

This summer I was pulled over. After passing a sobriety test(because I was sober, and btw I was pulled over for an expired license plate), the police officer lied to me so I would consent to a search. I can't go into the details of the case because it is still open, I won't tell you what I was arrested for. The police officer then made up a different story on the police report, I was really scared so I signed it and now I'm screwed.

If I would have recorded the audio from the beginning I would have been fine because I would have been able to prove the search was illegal and I would have evidence to file a complaint against the officer for blatant misconduct.

So, moral of the story, whenever you are stopped, record audio, try to do it secretly if you can so you don't make yourself look suspicious.

i learned a few things from some confrontations i had with the police awhile ago.

the first is more of a warning: telling a police officer they're wrong, even if done in a very polite manner, will piss them off. no getting around it. as an example, i was stopped at the beach near my house at around midnight. i was in my vehicle still on the road in the parking lot. long story short, the suspected i was in possession of illegal substances (i wasn't), and the first thing the police officer said was "you're not allowed to be here at this time of night" and he pointed at a sign. the sign did say that, but under the right to travel, i was allowed to be on the road. i told him this, and after the encounter he told me not to insult him like that.

police may take exerting your rights as an insult, especially if they weren't aware of the right to begin with.

second thing: logic rarely works, as they will do what they think they can. they thought i was smoking a certain banned plant (i wasn't, though it did look suspicious, i admit. i was using a glass apparatus that is usually only used to smoke said illegal plant. i like it because it doesn't burn my throat.) i asked if the officer had testing equipment, and he said he did, so i said, here, test it. he replied "wait". i offered a second time, he still declined.

once the backup arrived, they brought me out of my truck and cuffed me. i told them i did not consent to a search, he said he had probable cause with the apparatus. thing was, i showed him what i was smoking, explained what it was, and asked him to test it. his refusal to test, but then still saying he had probable cause because he hadn't tested it was wrong. i didn't want them to search because i had all my luggage and things from work, which is 500 miles away from where i lived at the time.

they let me go without charging me or anything because i wasn't breaking the law. they said my "punishment" was to clean up the mess they had made when they searched through all my things. it was a mess. bastards.

just be warned, most will be mad when you assert your rights, even if done calmly and respectfully. if you tell them they're mistaken about a law, they will also get mad, but make sure you do. asserting your rights is very important when a case goes to court, and will have the police officer in hot water.
