Firstly, I'm not sure who's the one engaged in nefarious and/or unethical behavior in the OP's scenario-- the site or the hacker? Secondly, what does
the right to do something have to do with its legal status? If it's a just action, legal status be damned. What is just is often as fickle as the law.
Anyone's actions are potentially just as "right" or "wrong".
The general direction of the wind says the state has the right while the mere citizen does not but that view is patently obtuse and strongly
conditioned by mental programming. The ethical problem with the state is that it is a situation of
do as I say, not as I do while for the
citizen is it a risk/reward assesment without the ethical contradiction (unless they usurp the establishment's power cloaked in the mantle of justice
and become indistinguishable from
them).
