Dear Mr. and Mrs. XXXXX:
Thank you for writing to me with your concerns about how new food safety legislation might affect small and organic farms.
As you may know, on November 30, 2010, the Senate passed the FDA Food Safety Modernization Act (S.510) by a vote of 73 to 25. You will be pleased to
know that the bill included an amendment authored by Senator Jon Tester to protect small farms. Small farms that sell directly to consumers and make
less than $500,000 in annual sales would be exempt from the new food safety requirements. In addition, the bill includes measures to provide
training, technical assistance, and competitive grants to help small businesses implement new regulations. S.510 also contains specific language that
protects and prevents conflict with national organic standards.
This legislation has strong bipartisan support and would improve the safety of the nation's food supply and help protect consumers from outbreaks of
food-borne illness. Because S.510 would require farmers and producers to meet new food safety regulations, I recognize that fulfilling these new
requirements could be more difficult for small farms than for larger operations.
As a long-time advocate of California agriculture and small family farms, I am proud to continue my efforts to ensure that new food safety reform is
mindful of the diverse agricultural industry in our state. Please know that I will keep working to help small and organic farms grow and succeed
while ensuring the safety of our nation's food supply.
