The US will transfer legal control of ousted leader Saddam Hussein to the Iraqi judicial system. He is expected to be arraigned in an Iraqi court on June 30th.
Though legal control will be transferred to Iraq, physical custody of Hussein will be maintained by the multi-national forces that have retained him since his capture. Physical custody will be transferred to Iraq when the country's security is improved enough to retain him.

BBC
Iraq's interim prime minister says former leader Saddam Hussein and 11 top detainees will be transferred to Iraqi legal custody on Wednesday.

The ex-leader will not face trial for several months, Mr Allawi said.

But the ex-leader will remain in a US-run jail until Iraqi detention services are ready to take physical custody.

Please visit the link provided for the complete story.

He probably has already been physically transferred to avoid trouble, wonder when he will finally get to trial - sure going to be a big crowd puller.

Iraq to get custody of Saddam
By Nadia Abou El-Magd in Baghdad, Iraq
June 30, 2004

"SADDAM Hussein will be transferred to Iraqi legal custody and face charges in an Iraqi court this week but he won't go on trial for months and he will stay in a US-run jail because the country doesn't have a suitable prison, the prime minister said today."

I feel it's too early to return Saddam to Iraq, as it would complicate the transition
and loyal B'aath fedayin(sp) would have a field day.

The new Iraqi government will take custody of Sadaam. The Bathist loyalists will kill off the current government and Sadaam will be back in power and slaughter all who oppossed him. Any bets?
