I need legal help, so I turn to those with more knowlage. My question is this.....

Can a single person, or group of people bring a lawsuit against the president and/or his officers?

Ok. I will bite.

Pertaining to what exactly? Is there evidence of wrong doing?

Your best bet (if you want to live) is to bring it up in the media, and if you have a case, a lawyer will surely find you.

I'm not sure if you can sue the government as a whole. Individuals like the President, of course. A lawsuit is always for a civil matter, though, not a criminal one. If you wanted to sue for political wrongdoing to the detriment of the masses, in a criminal context, proper persecution would be required.

Yep Phage if that nutcase can sue the government (not successfully mind you) ANYONE can sue the government.

Actually the government has to deal with a lot of lawsuits, and they don't always win either.

So go ahead, try your luck OP, sue the government.

The bigger issue here is why you are suing the government, or members thereof. Make sure to look at case history, and if there are precedents for what you are doing.

There are certain arguments that have legal precedent to be thrown out of court outright, and continued bringing of unwarranted lawsuits can get you into trouble too. Research is going to be your best bet here, as is legal advice. Perhaps getting in contact with a lawyer would be a good move too.

So, let's hear it though, since we are all quite curious now, what's your issue, why do you want to sue?

The case is this:

The friend of mine in AZ (the elderly lady that use to be my neighbor), had her house broken into the other night by 6 illegal imagrants (The police were called and located the men, no ID found, Police stated that they were illegals.) She is allright, but they ransacked her house, killed her dog, and threatened her. She wanted to know: "If the government can file suit against AZ for their enforcement of the immagration law, can she, and some of our friends that have likewise been victimized, file suit against the Obama and other people in the government, for not enforcing the FEDERAL immagration law, and therefore contilually putting them potentially in harms way?"

I told her that I had access to a bunch of people who have more smarts than me, and that I would ask. Thankyou for your replies.

Not an attorney, but it sure sounds like a case to me. She might have to start at the state level...can you go straight to suing the fed?

In fact, all the states should turn around and counter-sue the federal government for people exactly like this poor woman and for so much more...dereliction of duty and disobeying/not enforcing our laws for one thing. Breech of contract for not guarding the borders. And also laundering illegal money that they "claim" can't be traced (RICO). It's going to be one of the only ways we can save this country. Why aren't the states doing this?

Instead of suing the government because in reality the suit if it is won will be paid by the taxpayers and if it is lost will still be paid by the taxpayers.

If you want to bring action against the Government, take a stand with your values and run for office.

Ok here is the correct answer. Yes. But only if they say you can sue them. The only exception to this is a loophole under the Federal Tort Claims act. It provides a limited waiver of the federal governments immunity if the governments employees are negligent.

Given your situation you would have to prove that these six illegals were here due to the feds negligence rather than their own inginuity. If you can do that then you qualify for the exception if border patrol was negligent and knowingly allowed these six men across to victimize you.

Since that isn't the case then you wouldnt qualify. SO then you are back to asking the federal government for permission to sue them. And they would most likely answer no.

I'm not so sure you can. Look at the birther lawyer who was trying to sue Obama before he took the oath of office. A circuit judge dismissed his case because the lawyer lacked standing (didn't have the authority to sue).


U.S. District Judge R. Barclay Surrick dismissed the complaint in October 2008, finding that Berg lacked standing to bring the case and that his attempts to gain standing to pursue his claim were "frivolous and not worthy of discussion." - en.wikipedia.org...

Unless you have infinite funds and time you'll lose. You can have a case and file suit but they can just hold you up over and over and over until you either can't afford to continue going forward or you just give.

Having a bunch of politicians on your side could help but unless hour suit is wholly partisan it's doubtful you'll get any support since the politicians wouldn't be able to wave it around to their constituents.

I want to see a RICO brought against the fed. To see all those extorting and murdering thug bastards carted off to pound-me-in-the-ass prison and the whole thing reenvisioned without the violence and theft.
