A taxi driver who raped a teenager after she passed out on his back seat has asked for mercy in Adelaide's District Court.

Hajy Baba Rahmanian, 60, was found guilty of rape by a jury and is awaiting sentence after losing an appeal against his conviction.

The court heard that in June 2006 the 19-year-old victim got into Rahmanian's taxi after a party at North Adelaide.

Her friends rode with her to Hindley Street in the city where they got out to continue celebrations and told the taxi driver to take the victim home because she had been passing out and was severely intoxicated.

He said the Iranian immigrant did not fully appreciate the severity of the crime under Australian law.

"There is a very reasonable possibility that given his cultural background and limited insight into laws and sexual behaviour, he didn't realise that having intercourse with somebody who is unconscious and therefore not consenting is a very serious crime," Mr Algie told the court.

"Mercy, in my submission, could and should have a significant role to play in Your Honour's sentencing.

"He is extremely remorseful about the current situation concerning the impact on his family."

Another example of someone entering australia with a complete disregard and contempt for our legal system. Most taxis in Australia are staffed by immigrants.. that of course does not make them more likely to be rapists but for a lawyer to use the "but things are different where he comes from" excuse sets a disturbing precedent. If the judge doesn't throw the book at him and he walks what kind of message will that send to the community? Any crime commited by immigrants could be blamed on not understanding our laws and culture.

It not just Aus where that is happening. I could probably find references for many parts of the western world. I also think the argument that he was not aware of the severity of the crime is a very week defense in a case such as that. I hope he attorney was aware of that.

As someone's already suggested, throw the damn book at him .. HARD ... then toss him back to Iran

that way, other immigrants will gain an education as to what will not be accepted by Australians in Australia

If the media wasn't controlled by whores, it would be pressuring Iran to explain it's expatriate-rapist's claims

Ps: hope the lying cabbie is put in jail alongside dedicated racists

and if the judge let's him off with a slapped wrist ( as Oz judges are prone to do in the case of lying immigrants) I hope the victim's father arranges for justice to be seen to be done

That really bothered me as well. Blaming his race for his actions.. the lawyer is saying that rape is more accepted in Iranian culture. If I were Iranian I'd feel very insulted.
