I am the only person I know who has actually been charged with DUI, marijuana. I drove into a license check, I was not smoking weed that day, or even the day before, matter of fact it had been well over a week. While showing my license a passenger in my car had an open container of beer between his legs. This prompted the officer to ask me if I had been drinking, perfectly understandable imo, but I had not. He gave me a series of 'field sobriety tests' which I was told I passed. Another trooper approached the one who just tested me, and asked if he could test me, the other trooper took an ink pen, moved it back and forth telling me to follow it with my eyes only. I did. Then he moved it close to between my eyes, then declared I was under arrest for DUI. He said he smelled a strong odor of alchol on my breath (???) and I was arrested and taken to jail. At the jail I was happy to give a urine sample, I knew then I could prove that I was not drinking and driving ( I rarely drink anyway), instead when I went to court, I had a charge added, Internal possesion. I told the judge that I thought this was absurd, that I had not smoked any on that day or for days before that, but he declared that if it is in my system, then I am commiting a crime, whether I still feel it's effects or not. Then he added the charge of internal possesion. 2 years probation, 3900 dollars later, oh and I was forced to complete DUI classes before I could get my license back, I had to wait 4 yrs before I could get them back, they were suspended 2 years for each charge. This was just wrong. If there were any way to determine if you have it in your system or are you high right now, it would not matter, it is illegal and still warrants the same penalties and fines as if you were on a real drug.

edit to add: just wanted to clarify the fact that I was not drinking the day of my arrest, nor taking any other drug, nor was I high on pot. My uring test proved

I'll tell you what I think....way too late for me anyway! Who wants an organ transplant at my age anyway? I already have nylon staples on in my lower stomach, a stent on my heart valve, and 3 1/2 ounces of Titanium in my lower spine. what do I want with someone else's organs? This is a fine rule for kids who have never partaken, but where do you find those these days?

Not that I agree with it.. I understand it. There are many many people that need transplants, but not enough to go around. And so they have strict criteria.

Afterall, this man could legally drink. But that would still disqualify him, if he drank often and they knew of it.


Legally, it is the same. But there is a big difference between drinking and smoking pot. It was just a comparison.

It may be too late for your case, but if I were involved in that situation I would of told them I had visited Amsterdam about a month ago and indulged hence why I tested positve for the said substance. Also I would have demanded a trial by jury(the system hates it when someone does this) That is crap and cases like yours make me want to burn an American flag.

if you want to live in america and treat your illness with med mj, you have have to be willing to accept

it is still federally illegal, and only legal to you on a state level, you can be prosecuted at any time by the government

technically you cannot be 'prescribed' it, that's illegal for doctors to traffic marijuana, they simply recommend it and sign a document attached to your marijuana ID card resume

you might get fired from work if you fail a piss test, even though you use legally

you will have to pay more *depending on state* to grow your own

you will be turned down from serious medical treatment, like surgery

generally speaking, wether you are treating cancer and hope not to die doesn't matter because people will not accept it as a legit reason, you are still just a drug addict and it is still just a 'street' drug

to clarify why i posted that, i just want to say

if you live in america, the laws and social system are way out of wack towards marijuana, and if you want to use it medicinally you will have to go through that system and adhere to it's rules and etc...

my stand point is although, yes, marijuana use should not neglect someone from live saving surgery, i have to this day not read sufficient documents proving that problems would not arise in some circumstances where marijuana use could get in the way somehow

also, due to the out of wack system in america towards mj, if you decide to go the medicinal mj route, you should at least look fully into this kind of information and NOT just assume you will be treated the same as if you were prescribed cough medine for a cough

some days i am just overwhelmed by how much evolving the human race has yet to do. we have created for ourselves some very complex social and cultural systems that without a doubt have done much to improve our quality of life. that said we still tend to cling to the patterns these systems dictate like frightened children clinging to our mommies at the edge of the pool.

I am not going to get into specifics on how I came into said strains but on the Government Marijuana System the US Federal Government controls exclusively 65 different strains and have smoked at least 15 of them and they are not toxic. The after effect and psychotropic affects are different from other street green.

G20 - G25 is the bomb, G60 is like whoa!

You pee in the cup, and test positive for marijuana, but you have a prescription slip for it!! No one would say anything to you if it were for say..tylenol 3..or vicodin.

You would say "heres my prescription, you can call my doctor and he will confirm all of my prescriptions".

But apparently thats not ok with an "illicit substance". Even when it is used to treat a condition.



I find it amazing that some pro-drug war ignorant types have no problem taking a couple tylenol with codeine without thinking twice, yet get mean spirited and flustered when cannabis is brought up in regards to anything. Such a backwards world full of backward brains. Tylenol is terrible for you're liver. At least cannabis can be eaten safely without roughing up you're organs.

No I'm not, proving that Government green is safe as if it were not I'd be dead or more debilitating then I am now. If others are talking about it and are being left alone I'd honestly expect that this thread will not be shut down as long as it's course is civil and no one attacks one another.
