Ruling allowing Taser use to get DNA may be nation's first

LOCKPORT — It is legally permissible for police to zap a suspect with a Taser to obtain a DNA sample, as long as it’s not done “maliciously, or to an excessive extent, or with resulting injury,” a county judge has ruled in the first case of its kind in New York State, and possibly the nation.

Niagara County Judge Sara Sheldon Sperrazza decided that the DNA sample obtained Sept. 29 from Ryan S. Smith of Niagara Falls — which ties him to a shooting and a gas station robbery— is legally valid and can be used at his trial.

Everyone, give us what we want or we will taser you into submission!!!

This angers me to no end. The police already extracted DNA samples from this man and screwed it up. They come back to the man, arrested him, asked him for another sample and when he say's no, they taser him and take it anyway. If this isn't trampling all over this man's rights, I don't know what is. Then you have this idiot of a judge rule it is justified.

I hate to say it, but this is going to be common across America now. The PTB now know that they can get away with this nazi like behavior and now you will start to hear about this all over the nation.

The only problem is he is a guilty man and he would have been freed otherwise.

This is how they are going to get us.

Everyone knows the justice system isn't 100%, yet they keep trying to make it so at the expense of our personal liberties.

Yes, the article states the man was the prime suspect of this crime, but remember, we are supposed to be innocent until proven guilty. And they tazed him to get him to comply. He wasn't resisting arrest or struggling with the police, he was simply saying no, which is his right.

This judge is basically saying it is O.K. to torture people if they do not comply with the police/courts. Make no mistake, tazering someone until they say yes is TORTURE! That to me is disturbing! The fact that our courts of law are backing this up is disturbing!

Any ruling invlving tazers, .....all people invovled in prosecuting or judging should have to first experience getting tazered before they recommend it as an OK thing to do?

This makes me sick. Is the judge a freaking fascist or what? That's basically forcing a person to self-incriminate. Last time I checked, the 5th amendment was pretty specific about that type of thing.

i hope they appeal this one, this is a bad precedent to set.
