You're arguing an ex post facto point especially since that obviously wasn't enough to force their way in that time & more importantly, the never gave him probable cause nor supplied a warrant, after he asked "Am I being detained?" to which they answer "no". When they changed their tune, they never gave probably cause other then the ramification of the incident that they fully incited as much as the driver; so no sorry, that won't hold up in court sir, especially if he has a good lawyer.

You have to really pay attention to what is being said & in what sequence if you want to play lawyer ball

Sad and Pathetic...

Let any of you "civil rights" activists try that at a sobriety check point which is COMPLETELY legal. You know, those checkpoints that stop you for being on a road?

That is a PERMENENT checkpoint that EVERYONE knows about. Why did he go there? To stir up trouble.

Grow up...

Outstanding video and thanks for posting it OP!

Say what you will but the citizen hung his ground and did not drive off a defeated or cowered person.

Nor was he made to appear grateful or feel grateful for being so ill considered and so derided in his own country, going about his own lawful business by mindless authorities of the state.

He was absolutely correct in everything he said and asserted and he truly had every right to assert and say those things.

This man is a hero!

I'm not sure if you're aware of this or not: but a lot of these border check points are on major freeways & arteries where there are little options to go around. More often then not you aren't searched which is why I think it's odd this guy was getting harassed in the 1st place. Although I wouldn't doubt they started recognizing him after this video, which may have contributed to what happened two months later.

So why did he go that way? Because you have to, plain and simple.

 

I find it interesting that so many of the comments are from those who think all problems can be solved with clinched fist & a heavy hand....very interesting indeed.

Internal Checkpoints are just so Gestapo like. It really is like Nazi Germany.

It is really tragic for the Border Patrol to be manning check points like this one 60 miles or more inside the border instead of putting these personnel on the border where they belong.

It is a huge misdirection of resources and is an in your face intrusion. To some people that travel that way it is an every day hassle not to mention a 4th amendment violation.

I have to say though that the pastor here is a bit of an adrenaline junky pure and simple. His motivation might seem pure but I think he might be in need of some cortisol suppressants like perhaps 200mg of phosphatidylcholine

and cut down on the caffeine.

But you're right that I probaply am looking at things through rosy glasses, it's my choice, but I'm not denying anything here, just trying to find some sense into this.

No, I'm not American, live in Finland, so here things are smaller and border policy is far from that, since we have only borders with Sweden and Russia, so there's a hell lot more clarity between the parties involved than the messy state policies what you have.
In my country the situation isn't this awful and can't think of any situation when "law would not apply" in a certain spot and that I would call insane that was said in the video.
None the lesss also the protocols of officials and general supervision of people are also easily being manipulated by leaning on single incidents (like school-shootings) and then it's used for abusing rights for privacy and gun-holding laws etc.
I don't promote anything, just want to think things from both sides before declaring anything.

Sorry that this guy's gone through really bad 'luck' before too. It's never fair to anyone.

This is very much a black and white situation.

The "border patrol" officers (who weren't on a border) decided that the constitution no longer applies when they are in charge. They are wrong.

How can you be glad it got solved with no violence, when the border patrol threatens him with violence? That's not only wrong, its blatantly illegal. How can you not "blame on either side for doing what they feel they must do", when quite clearly the border patrol agents were acting far outside of their legal rights?




My only point saying so is that they 'do their jobs' what they're paid by the best of their abilities. People in very strict and authoric positions can also be just as dumb as anyone else with only the one book to follow and see nothing else but his role of being the mr. Authority. And some can't get by the rules over what things are 'right' and what things are 'reasonable', people are very programmable in certain occupations and they adapt to their certain environment very quickly and behave according to the norms of that jobs 'climate'.
The officials weren't just bright and sensible anough to see pass their so called suspicion and let him go much sooner.
