Through out the years there have been many people who challenged the legality of income tax, and all of them ended up having to pay just like everyone else.

I have heard news stories of people having their house stormed by swat teams because they locked themselves into their house and refused to pay income tax.

I dont know, it seems to me that if there was no law saying you had to pay, then there would not be people getting thrown in jail for not paying.

Then again, in the constitution, does it not say that paying taxes is voluntary?

I am unable to locate an unbiased website that discusses this so here are two websites that sit on both sides of the fence.

Hopefully this info will help everyone take a fair and balanced look at this subject. I am personally on the fence and will have to do further investigation of my own before I post my opinion.

The reality is no you do not have to pay taxes, but...the Internal Revenue Service is excellent in getting people both witting, and unwittingly to start a "contract" to become what they like to refer to as and address as taxpayers.

Did you respond verbally or in writing to something addressed to you as a Taxpayer...guess what that makes you? Someone who doesn't know how to stay out of oral and written contracts.

Most people are duped through withholding tax. Did you fillout a W-4 at your employer and list your excemptions and sign it? If you didn't write OFFER OF CONTRACT REJECTED EXEMPT, and hand it back in to your stunned payroll or human services director, then you just entered into a contract. A contract you want to now fulfill because they are going to give you a little of the money back they are stealing from you everytime you get your paycheck. So when it comes time to get that little bit of money back you will sign the rest of the contract, and well now...it's too late.

Does your State say that by signing your Driver's Lisence your listed address of Post Office Box can now legally be served with official documents without you having to be in person (many states specify that as part of the contract to drive)...if you did, then well mail that shows up at your house with your name on addressed to you as Taxpayer, is just all part of that contractual process. Did you take a call from the IRS and say yes, I failed to file this or pay that...that's an oral contract.

There is no constitutional law requiring you to pay Federal Income Taxes except during time of war to raise and equip an army to fight it.

There are however all kinds of documents you have signed from your Driver's Lisence to your Social Security Card, to your W-4, and more depending on where you live and what you do, that form the base of a contractual obligation to pay Federal Income Taxes that you have voluntarily and usually completely unwittingly entered into, by contracting for these other services in privelages in the meantime.

That's what get's somebody like Wesley Snipes, or just about anyone who engages in the process of talking to the IRS in trouble, sooner or later, they are going to establish the contract that they need to, to prove what they want too.

Do Not Feed the Bears, Do Not Call Out to the Bears, Do Not Take Pictures of the Bears, Do Not Leave Food Out in Plain Sight for the Bears to See, Do Not Provoke the Bears, if the Bears notice you or call out to you Play Dead. If you so much as blink, say a word, or stir a muscle, the Bears Will Eat You!

I don't know what any of you are talking about. Not to be confrontational, but it sounds like you're spreading misinformation. The Sixteenth Amendment (Amendment XVI) to the United States Constitution which was ratified on February 3, 1913 very clearly states:


The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

This is another area where jury nullification would do a world of good. Juries should acquit alleged tax cheats even if they think they're guilty.

Give my regards to the easter bunny. The govt does what it wants. The courts are part of the govt and they are not gonna let anti-tax activists win. Being in the right means nothing in a courtroom.

Pardon my ignorance, but how can one possibly not pay taxes? In my world its impossible. When I get my check from work taxes are already taken out before I get it. Not filing a return isnt going to help anything...

The only way you are going to get away without paying your income taxes is if you are wealthy enough to afford a lawyer GOOD ENOUGH to force the issue into the lime-light.

If that happens, the Government will drop charges as they don't want to see the argument go before the people.
Why?
Becuase yes, it is true, the income tax law is unconstitutional.

I don't think this is "news" per se.

I had my wages almost garnished once. The notice had been sent to my employer and I only had a few days to straighten it out.

I went down to my local IRS Office with a 9-1-1 Tax Payer Advocate Form to request immediate and emergency action.

The guy behind the counter did not like that form! Please, he said, lets see if there is a way to resolve this here and now without you having to file the 9-1-1 Form.

It took about 5 hours in a little private office and phone calls to three different IRS Service Centers each dealing in specific portions of the Tax Problem before he finally got the go ahead to release the Levy from a high enough source.

His hands were shaking live a leaf and he looked at me nervously and said you are either the luckiest man alive or both you and I are going to jail for a very long time. He then confided with me in 22 years at working at my city's main IRS office, he had never before been given permission to or had to fill our a Release of Levy Form and prayed he would be able to do it right.

They do not like 9-1-1 Tax Payer Advocate Forms. They really do not like it either when you have no lawyer to help 'explain' to you, how things ought really be done.

My best advice is make it one person's problem, face to face, who works for them, and tell him just like I did, someone has to be accountable to me in this process, face to face and tag, you are it! Then make them be accountable. It works both ways you know.

Is this just an assumption on your part? I ask because this statement is simply flat out wrong. Many people have taken their case to court, or had it taken there for them, and ended up winning. More and more all the time. If you spent as long looking for case results as you did typing this statement, you'd realize that you were flat wrong.

The people that lose these cases, do so for one of two reasons. They end up in a court with a judge who does not want to hear their case, or they don't come with a proper case.



Tommy explained to the jury that his study of the U.S. Constitution, the U.S. Supreme Court decisions, the IRS Code and Regulations convinced Tommy that he was not an individual who was required to file and pay the Federal Income Tax, despite the fact that Tommy made a living as an attorney. The Government lawyer never offered any Supreme Court decisions, IRS Code or Regulations to refute the Supreme Court decisions, the IRS Code and Regulations that Tommy Cryer had relied on to conclude that Tommy Cryer was NOT required to file an income tax return.


Doesn't seem like it would be all that difficult for the gubment attorney to simply whip out the law in this case in order to win and send the defendant to jail. Ended up being more difficult than it seems. As it turns out, it's tough to show someone (in this case, the defendant, the jury, and the judge) a law that doesn't exist.

Get the right judge, the right jury, and go prepared. It's not that difficult to go prepared, it's getting the right judge and the right jury that's difficult.
