Who sent soldiers into an Alabama town last week?

blogs.usatoday.com

Who sent 22 military police and an Army officer into the tiny Alabama town of Samson last week after a gunman went on a rampage that left 11 people dead?

That's what the U.S. Army would like to know.

The Associated Press reports that an Army spokesman says the military has launched an inquiry to find out what happened, why the troops were sent from nearby Fort Rucker, what they did while there and whether any federal laws were broken.

I cannot believe this this is as close as we can get to martial law without an executive order. Im actually quite alarmed by this.

Could this be a play by the Government to see how we react to soldiers in our streets???

Mind you this was not national guard this was US Army. This is scary my friends this happened and no one is reporting it really.

This is illegal. We can not stand for this type of action by the government. So much for the constitution

Glenn beck just talked about this on his show.

He called the government...the department of justice...the governor of AL....everyone.

He couldn't get an answer.

This is a direct violation of the Constitution....seems to be happening alot these days right?

Our government is running amok and we are letting them do it.

I just caugh the tail end of this on Glenn Beck. What surprised me, and I'm paraphrasing, is that he said something like this is the first time..it's not. I know I've recently seen this same stuff in Rhode Island and California.

Combine this info and HR 1388 and I just don't know what to say.

It's called the Posse Comitatus act

The Posse Comitatus Act is a United States federal law (18 U.S.C. § 1385) passed on June 16, 1878 after the end of Reconstruction, with the intention (in concert with the Insurrection Act of 1807) of substantially limiting the powers of the federal government to use the military for law enforcement. The Act prohibits most members of the federal uniformed services (today the Army, Air Force, and State National Guard forces when such are called into federal service) from exercising nominally state law enforcement, police, or peace officer powers that maintain "law and order" on non-federal property (states and their counties and municipal divisions) within the United States. The statute generally prohibits federal military personnel and units of the National Guard under federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. The Coast Guard is exempt from the Act.

As scary as that is, I don't think it was a test to see how people react. My justification for that is they did it in a tiny Alabama town, not really your best test market, unless you want a reaction from the Gun/Bible belt.

I am assuming they were looking for UFO's
or maybe the locals couln't deal with the gunmen and called in the aid.

If it's not those things then the government is taking very bold strides in trying to dissolve the military within the ranks of general law enforcement to blur the lines of what is acceptible and what is not.

Remember all they need to do is do it enough so that the general population just thinks it's the norm. The average American has no idea what his/her rights are or what the laws state about most things. It's very easy for them to just make people think they are acting within the law.

Granted I know little of the details of this story but if you want my honest opinion the reason for the military involvement is probably because the military had some level of involvement. Does anyone know if the shooter had any sort of relation to the military?

Instead of crying about it being against your constitutional rights why not USE your constitutional right to overthrow your government??
I am Canadian so excuse my ignorance about the constitution.
From my point of view I believe it says something along the lines of if your government gets rogue, then you have the right to form a new one.
Excuse me I had a few beers.

But not if the Guard is not called into Federal service and kept at state level......

Show me where that was illegal according to the Posse Comitatus Act.

No one knows if they were active or Guard either. This ENTIRE TOPIC already exists here:

It must be expressly authorized and if I am to assume this article is correct it seems no one knows who authorized it.

EDIT: And I believe that State Guard would need to be authorized by the governor

"Which Rights have they not broken in the last 2 years?"

Really, what do you expect them to do? They're dealing with an ignorant population which is more than happy to relinquish their rights for a song and dance. If they push and nobody pushes back...well...you know how that story will end.

If you see this happening and don't ask questions or talk about then you are helping them. You are aiding them in desensitizing the population to their presence. TELL SOMEBODY and FOLLOW UP with it!!

I'm thinking a call was placed by the police department to Ft. Rucker for some MPs to help with guarding the scene and the Post Commander sent them without asking DC for authorization.

A General just lost his commission, retirement and could possibly go to jail. Probably not jail, but a dishonarable discharge is coming. To much press for a slap on the wrist.

You know what? The next time that you and others wish to bash the Military and paint them with an absurdly ludicrous "Black Brush" of Malevolence, just sit back and realize how truly fortunate we are to have the finest Men and Women serving our Nation, and consistently dealing with the issues that MANY seem to wantonly ignore.

There was NO law breaking in this case, as the Military responded to an Emergency Call for Assistance from the Local Law Enforcement Agency. They did NOT conduct Searches and Seizures, they did NOT Arrest anyone, so therefore they did NOT break Posse Comitatus.

The Base Commander has the Ability, and RIGHT to deploy Personnel under his/her command when they see fit. They do not need approval from Washington, or Regional Command, unless they are facing a War deployment towards an International Theater of Operations. If God Forbid Washington is ever wiped off the Map, what should the Base Commanders do, sit on their thumbs waiting for Orders?

During Emergency Calls they are given leeway in regards to their Command.
