It is very likely that USCIS will reach its H1-B cap for the 2009 fiscal year very soon after April 1, 2008. Last year, USCIS reached its H1-B visa quota in just one (1) day.
Through the H1-B visa program, U.S. employers can hire highly educated foreign professional workers for “specialty occupations.” These workers need to have at least a bachelor’s degree or an equivalent in the field of specialty. H1-B visa holders can stay in the United States for up to six (6) years.
H1-B visas are limited to 65,000 per year. However the following exemptions are not included in this H1-B cap: 1) extensions for current H1-B workers; 2) concurrent employment in a second H1-B position; 3) petitions which are amended; 4) petitions for new employment at exempt organizations such as a nonprofit research organization, a higher education institution or an affiliated non-profit entity and 5) 20000 H1-B visas for graduates of U.S. colleges who have earned a Master’s degree or higher.
