Only Congress can declare war. The President has to ask them to declare it, and they vote on it. World War II was our last officially declared war. (The others are called "police actions".)

I have a copy of the Constitution somewhere, and when I find it will post where the article is located. Read the whole Constitution, and see what a great work it is. At over 200 years, it is still a viable document.

But remember, a President can initiate a war action on his own, although he is forced by law to approach congress thereafter for approval and an explanation.

But if you are talking about "declaring" war; only the representatives of the people can do that legally.

Only Kings and people in power 'by divine authority' can declare wars their country's are obliged to wage.

The Constitution (and other such documents) changed that because, after all, why should I send my kids to die somewhere? Just because my 'ruler/leader' wants it?
