Evidence Faulted in Detainee Case

In the first case to review the government’s secret evidence for holding a detainee at Guantánamo Bay, Cuba, a federal appeals court found that accusations against a Muslim from western China held for more than six years were based on bare and unverifiable claims. The unclassified parts of the decision were released on Monday.

With some derision for the Bush administration’s arguments, a three-judge panel said the government contended that its accusations against the detainee should be accepted as true because they had been repeated in at least three secret documents.

The court compared that to the absurd declaration of a character in the Lewis Carroll poem “The Hunting of the Snark”: “I have said it thrice: What I tell you three times is true.”

“This comes perilously close to suggesting that whatever the government says must be treated as true,” said the panel of the Court of Appeals

This article is a perfect reason for why the Gitmo gulag should be closed. A Federal appeals court has struck down the govt's first attempt to try a prisoner of the Afghan war as an enemy combattant, and has done so with mockery and scorn.

The secrets are so secret that the Justice Dep't would not allow the court to see the evidence, simply pointed out that three documents which they weren't allowed to review contained said secret evidence.

And who is this grave threat to national security, who merits such uber-secret secretness?


Although the decision was a defeat for the Bush administration, it was unclear what it might mean immediately for Mr. Parhat, a former fruit peddler who in recent years sent a message to his wife that she should remarry because his imprisonment at Guantánamo was like already being dead.

The headline must be the headline of the article you reference in your opening post. There are no doubt many many news stories out there on this each with different headlines. You cannot pick and choose.

Ah sure 'n' we could close it down, but where in secret will it be springin' up again?

The closing of Gitmo will merely force them to move more secretly (almost seems impossible that they could be more secretive, eh?). Perhaps they will use one of those 600+ empty FEMA prison camps - one that is isolated, I would think.

Then again, maybe those prison camps will all be filled soon, and none of us will have any say in who they incarcerate.

Interesting thing about those FEMA camps... They can hold, at the lower estimate, ten times the number we currently incarcerate here in the US.

Right now, the "Land of the Free" incarcerates 25% of the world's incarcerated - a little over two million are held in prison. This, despite the fact that we have only 5% of the world's population.

The FEMA prison camps - the ones above ground - can hold a minimum of TWENTY million. With thousands of boxcars that can shackle 150 humans at a time. (And this does not include the unknown number of underground facilities that might be able to house tens of millions more...)

All this came into being under the guise of being prepared to handle a large influx of illegal aliens (Mexicans, primarily).

Are we expecting the bulk of Mexico to all move across our border??? I think not. So what can these prisons possibly be used for?

Needless to say... Gitmo is small potatoes.

the title of this post in this forum MUST be the title of the article. Not some sensationalist hook in some attempt to raise your ATS points.

The real title is "Evidence Faulted in Detainee Case"

The original headline was that used as the lead in the HP. Don't go recklessly charging people with T & C violations without reading the post first.

Besides that, any comment on the article itself?
