The American Civil Liberties union is backing a Kearny High School student who objected when a teacher made religious statements in the classroom, including allegedly telling students that those who do not believe Jesus died for their sins belong in hell.
The student's lawyers filed a notice of claim on Feb. 13 against the school district, claiming that instead of addressing the teacher's conduct, it penalized the student for secretly taping the teacher.
Among other things, LaClair claims that Paszkiewicz told students evolution is less fact-based than the Bible, there were dinosaurs on Noah's Ark, the Big Bang theory of creation is unscientific, and that the Bible has been proven to be literally true by the fulfillment of Biblical prophecies.

The infringement of the first amendment would have taken place if the school condemned the students for speaking of their beliefs.

Then again, I haven't been educated in the public school system for years, and not to mention I could actually defend my beliefs at the High School age, not being a useless tool who could have my intellectual rights infringed upon.
