Not the crime. Crimes as specified by the Supreme Court, are "Personal and Individual." Without evidence of coercion, the individual committing the
crime is culpable.
However, there could certainly be some limited civil culpability involved, unless the officer was (a) Under Orders (b) On Assignment or (c) Some other
specific rational defense.
Remember, the police are in no way obligated to enforce every crime. Each Police Officer is sworn, however ever state I have worked in, specifically
gives the officer "Discretionary Powers of Enforcement."
This is ABSOLUTELY necessary. If not for this rule, an officer on an important felony stakeout would be required to pull off the stake out and go
after a Jay Walker.
