Anyone Here Think Zacarias Moussaoui Can Get A Fair Trial In America?

Recall the Supreme Court’s 1938 decision - still the law of the land - required open court confessions to be “freely given, knowingly given and intelligently given.” No one doubts the first requirement has been met. Sure, someone could have been secretly holding his mother hostage threatening to kill her if he did not confess, but that is more of a stretch than is indicated in this case. [Knowingly. Adj. The state of being aware or informed. Intelligently. Adj. Having intelligence especially of a high level.] It is not at all certain that Zacarias meets either of those two closely related requirements.

America is a tough place. It was just last year the Supreme Court said states cannot execute any person for a crime committed before age 18. Wow! Dam Liberals at work again! President Bush is no stranger to death. He ordered the execution of 154 persons during his 6 years as Texas governor. One person every 2 weeks, on average. A world record unlikely to ever be surpassed. Wow! He must be one tough nut! (Im’ curious, was his stint as governor - 1994-2000 - before or after he was “born again?”)

Again, while I have a human concern over the fate of anyone in my care, custody and control, the system [legal institution] is more important, more consequential, more essential that the fate of one person. And very vulnerable to both neglect and to abuse. To preserve it requires care and concern of many if not all our citizens. “You who have done good to the least of these have done good to me.” Hmm?

OTOH, a system that cannot guarantee justice to even the most despicable, most disdained person in our midst is not a perfect system [institution]. Reflect back on how African Americans got short shrift before the American bar of justice only a few years ago. Reflect on the Jamaican who was shot 41 times by the NYPD? You say, hey, this is the land of the free and home of the brave?

Anyone here remember Rodney King? Do any of you doubt that sans the amateur camcorder video that Rodney would have ben charged with 1) resisting arrest, 2) assault on an officer, 3) drunk driving, 4) reckless driving, and that favorite catch-all so often used in America, 5) disorderly conduct.

And, Rodney’s public defender would have conscientiously recommended a plea of “guilty” to DWI and RA only, in exchange for a reduced sentence? Ignoring all the time, Rodney’s protestations of innocence? Volume. The American mantra. The PD office is faced with too many cases, too few resources. That is another issue but one point, consider that in most states, the PD office is funded at about 20% of the prosecutors office. Hmm? Would it be too much to ask for parity? Of is our sense of justice really just not that deep or real? I mean, I’m reminded of those who said, “Hitler did a lot or good . . . “ Yeah.

You may like it here, the way it is, and think it is funny and even appropriate to lynch someone you don’t like or of whom you are afraid, but it is my opinion even at our best, we are a work in progress, and presently we are taking 3 steps back for every half step forward.

mentally challenged? I never heard that, I heard he had below normal intelligence but isnt that common amongst al qaeda?

Actually this trial could be based on other high profile trials of the past. Watergate/Mai Lai/ Iran-contra/JFK/RFK/MLK/OJ/Michael. Its the opiate of the masses, that's entertainment. Let's keep the underclass occupied and fighting each other while we continue to rob them blind. They take our time our $, our children to war, fill our minds with visions of nobility, enlightened ethnocentrism, why they even lead us into nuclear war. Wait they haven't done that.--------------- Yet!
