Most will not be surprised to read this story, others will try to argue for it, the former are the only ones with the correct view here.

Lead prosecutor in the "manslaughter" trial of Marine Veteran Daniel penny, for the 2023 death of Jordan Neely, has a history of being on the side of "restorative justice". Some of you might wonder what "restorative justice" is, in essence it is getting the offender off on almost no charges and "integrating" them back into the community while allowing the victim access to "reparation's".

In one instance, in 2019, "restorative justice" was not served for Dr. Yung Kum Kim, when he was brutally assaulted over $300 and subsequently died of his injuries by a mugger in NYC. The assaulter, Matthew Lee, was under representation of Assistant Manhattan District Attorney Dafna Yoran, the current prosecutor of Daniel Penny.


Throughout Penny's entire trial she has been trying to sway the jury towards thinking of him as a racist murderer. This trial is not one of a hate crime, or of a murder trial, the only charges are of manslaughter. When instructed by the judge to not use those descriptors, she ignored.


The jury is currently in deliberations and I hope they find Penny not guilty. This was strictly a self defense situation for himself and all others on that subway that feared for their life.

When are we ever going to be able to rid NYC of these corrupt and irrational attorneys? I know the answer is never but what will be the line that is crossed to make the people of NY actually see them for what they are?

"Restorative justice" is just a fancy way of say "Payback bitches".

From what I've read about the case, the guy had a long history of mental illness and crimes, but judges kept turning him right back out on the street. People are sick and tired of this crap. You have some unpaid parking tickets and they send a SWAT team, but if you carjack somebody you get out on probation.

History of mental illness, assault, threats on the subway.

Had synthetic drugs in his system at TOD.

Daniel Penny was cooperative with police, stuck around until they showed up, asked if he needed to go downtown with them and was told no, did not know Neely had passed until much later and when informed he was wanted by police turned himself in without incident.

It is corrupt attorneys such as this POS that are making every day people, who would normally willingly help out police or anyone else in need, not want to do anything and just mind their own business.

Then of course the news puts out a picture of the guy when he was like 15. The guy in the subway looks 40.

That picture was from 2009 when he was a "Michael Jackson impersonator", I'm sure before he got into drugs, violence, and homelessness

Prosecutors will do anything in their power to try and make the "victim" look as innocent as possible.

We lost something along the way when the prosecutor has a win-at-all-cost mentality. It isn't their job to "sway" the jury. It's their job to provide enough evidence and facts so the jury can make logical decisions.

It paints a picture that all White people live some luxurious life off the backs of minorities, and there are 5x more Whites under the poverty line than Blacks and that is a lot of people. I know people talk about percentages, but my point is most White Americans fall into the poor, just above the poverty line, lower middle and middle class. None of that scream gaining some edge off the backs of minorities. It just means White people work for a living mostly.

Speaking of percentages... Under Obama, Blacks reached 27,5% under the poverty line, by 2019 under Trump almost 10 percent was reduced as only 18% were under the poverty line.

It's like a challenge for them, a sport in which they do not get a victory unless they win the case. In so many cases they should not win because the person did no wrong, but if they could have 100% conviction, they would take that in a minute.

those who want Penny punished, must not now, nor ever plan to ride the subway. With the charges brought, (not even a factor of a conviction) most who would have acted in a selfless way to assist others and stop an attack, won't bother next time. Nobody wants to be treated like this. Penny was genuinely trying to help everyone on that train. He stated immediately that he had no intention of harming or killing Neely. But the facts don't seem to matter. I do hope he is found not guilty, but the damage is already done. This might be a quiet death blow to NYC. More and more will move from that place to avoid idiocy with leadership.

If he is found guilty it would just be, as we have both said, a blow to those that would go out of their way to help someone in need.

Why go out of my way to help you when it will just get me jammed up for trying to be a good person.

There was a story years ago about several Us citizens, several Veterans, stopping a terrorist attack on a public train in Europe and they were awarded medals and accommodations for it. One told police he got the gun away from the attacker, put it to his head and tried to blow his head off when the firearm malfunctioned. If that would have been in NYC he would have been put away for attempted murder, regardless of the fact that the guy was a terrorist.

I doubt that line will ever be crossed as far as the people of NY are concerned.......most of the people for whom the line would matter have left.

What would it take for it to matter to those that are still there?

Would someone they care about getting into a situation, such as this one, getting railroaded by the Manhattan DA to make them see the corruption and call for something to be done?

chances are, they will just have a funeral to arrange, as the guy who might have stopped the attack, won't be there.

FAFO. Penny found out. Now I bet he would not have done it had he known this would happen. I'd be interested to hear his opinion on that. But over zealous DA's will always be an issue.

Usually, in cases such as Penny's, they would do it again just to make sure that nobody else has to get hurt or killed.

Being a Marine veteran, I would almost bet money he would do it 100000 times over just for the safety of everyone else on that subway.

Neely was scum of the Earth, he was definitely the winner of the FAFO award being given out on the subway that day. He chose that time to go on a "I don't care if I end up in jail, or worse" tirades and he chose poorly.

The longer the jury takes, it's probably not going to go Penny's way.

If I was on that jury, within 1 minute of starting to deliberate, I would have said "Not guilty. And nothing the rest of you say is going to make me change my mind, so you might as well join me"
