REMEMBER retired Airforce Officer Robert Birchum, when Special Prosecutor ROBERT HUR completes his criminal investigation of JOE BIDEN's mishandling of Highly Classified Documents and "Materials", and gives his recommendation(s).

TAMPA, Fla. (AP) — A former U.S. Air Force intelligence officer was sentenced Thursday to three years in federal prison for keeping classified documents at his home and other unauthorized locations.

Robert Birchum, 55, was sentenced in Tampa federal court, according to court records. He pleaded guilty in February to unlawfully possessing and retaining classified documents relating to the national defense of the United States. Birchum was also fined $25,000.

According to the plea agreement, Birchum, who retired in 2018 as a lieutenant colonel, served in various positions in intelligence over his 29-year career, including those requiring him to work with classified intelligence information for the Joint Special Operations Command, the Special Operations Command and the Office of the Director of National Intelligence.

The Lt. Colonel pleaded guilty to possessing and retaining classified information.

Title 18 U.S.C. 1924 makes it a crime for any officer, employee, contractor, or consultant of the United States government to knowingly possess classified documents and remove them without proper authorization.

When the Lt. Colonel took and kept these documents he was still an officer. Therefore, he was subject to this law. When Trump, Biden, and Pence were found with the documents marked classified, they were out of office and therefore did not come under the jurisdiction of this law.

Instead, they came under the jurisdiction of the Espionage Act, AKA 18 U.S. Code § 793 - Gathering, transmitting or losing defense information, which states, in part:

"Whoever, for the purpose of obtaining information respecting the national defense with … reason to believe that the information is to be used to the injury of the United States or to the advantage of any foreign nation ….. copies, takes, makes, or obtains, any…. Document … connected with the national defense …. willfully communicates, delivers, transmits …. the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it …. Shall be fined under this title or imprisoned not more than ten years, or both."

Pay special attention to the first word: "whoever". That means that the law applies to anyone, not just a government officer, employee, consultant, etc. Also note the phrase: "willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it". That's the difference. When Pence and Biden discovered the documents marked classified, they delivered them on demand to the officers entitled to receive them. Trump didn't.

Trump was exempt from having to "return" what was already declassified and his property under law. Obama did the same thing with far more documents and no one ever went after him.

FBI Director WRAY is bringing the Incriminating Biden Document to the Capitol building this coming Monday...

The FBI is preparing to bring the subpoenaed document alleging Joe Biden was involved in a criminal bribery scheme to Capitol Hill Monday (June 5th) for lawmakers to review, after House Oversight Committee Chairman James Comer threatened to hold the bureau in contempt of Congress.

The document in question is an FBI-generated FD-1023 form that allegedly describes a $5 million criminal scheme involving then-Vice President Joe Biden and a foreign national relating to the exchange of money for policy decisions.

A source familiar told Fox News Digital that the FBI will bring the FD-1023 document to Capitol Hill Monday for Comer, R-Ky., and the top Democrat on the committee, Ranking Member Jamie Raskin, D-Md., to review.

Comer and Raskin will view the document in a secure SCIF on Capitol Hill, instead of going to the FBI’s headquarters. Fox News has learned the lawmakers will also be briefed on the document in the same location.

The exact time for the viewing and briefing Monday is unclear.

Exactly. Trumps only proof that he was victimized by the Obama admin lies in those docs. Operation Crossfire Hurricane, which he declassified 3 days before he left the White House.

Everyone of us would behave the exact same way Trump has, in moving and hiding and copying these docs.
