Sometimes I wonder if there is a major battle going on behind the scenes, within the Supreme Court Congress and the President, or is this just all political theater for the midterms?

Part of me is thinking TPTB just wants the names floating around with the words subpoena, investigate, and Grand Jury knowing the average schmo will think that's not a good thing.

Part of me wishes our Congress was so thorough in approving all the aid to Ukraine.

Thomas, who is responsible for emergency applications such as Graham’s issued out of the 11th Circuit, issued the hold on the subpoena on his own accord, without referring the question to the entire Supreme Court.

The conservative justice said the subpoena would be delayed pending further order by Thomas or the Supreme Court. Two days before he issued the stay, Thomas told Fulton County, Georgia, prosecutors, who are presenting evidence to the grand jury, to respond by Thursday to Graham’s request for a stay of the subpoena

Supreme Court Justice Clarence Thomas on Monday temporarily blocked a subpoena demanding testimony from South Carolina Republican Sen. Lindsey Graham from a Georgia grand jury investigating election interference by former President Donald Trump.

The hold on the subpoena came three days after Graham’s attorneys asked Thomas to delay the senator’s appearance before the grand jury, which is investigating possible criminal interference in Georgia’s presidential election in 2020.

On Thursday, a panel of judges on the 11th Circuit U.S. Court of Appeals unanimously rejected a request by Graham to temporarily block the subpoena, which calls for the senator to testify on Nov. 17 in an Atlanta courthouse.

The appeals panel said Graham had failed to show he was likely to succeed on an appeal challenging the legality of the demand for his testimony. Last month, a federal district judge upheld the legality of the grand jury’s subpoena.

The grand jury specifically is probing the actions of Trump and his allies, including Graham, who contacted state election officials and others on the heels of the election, which was won in that state and nationally by President Joe Biden.

It's merely procedural. Thomas granted a temporary stay while the rest of the Justices determine whether or not they will hear the case.

Possibly but it would seem this congressperson doesn't see it that way or am I wrong? why is he so uninformed and why didn't CNBC mention it is just "procedural". It is painted as a conservative is trying to delay this and save Graham.

not trying to be confrontational and could care less about Graham, but seriously why isn't it being just procedures not mentioned anywhere in the article?

Rep. Mark Pocan, D-Wisconsin doesn't seem to believe it is procedurally at all, is it theatrics? or does this representative really believe what he is saying?

Rep. Mark Pocan, D-Wisconsin, blasted Thomas on Twitter for blocking the subpoena, tying it to the justice’s wife Virginia “Ginni” Thomas, who had encouraged Trump White House officials and state legislators to overturn Biden’s victories in swing states.

“Disgusting. Any other judge in the country would recuse,” Pocan tweeted, using the legal term for a judge declining to handle a case because of a conflict of interest, or other reasons.

Rep. Jan Schakowsky, an Illinois Democrat, tweeted, “Another day, another conflict of interest for Justice Thomas revealed.”

“Add this to the laundry list of impeachable offenses he has committed. He has no business being on the Supreme Court, and no shame,” Schakowsky added.

I'm trying to re-find a link to the actual ruling. But it says in the ruling that the stay is only until Fulton County submits their response to Lindsay's appeal request, due by the 27th, and then the Justices review the case.

FWIW Xcalibur254 no worries I know you are likely correct, hopefully, though you see the article is divisive as hell, and so is the Wisconsin Representative. Why all the bluster and accusations?

All congresspersons are up for election, but he is in a solid Democrat 2nd district and isn't under any pressure for this election at all. Perhaps fishing
for donations?

So now you understand routine judicial procedure?

You referred to the normal practice of mounting a full defense as a "delay tactic" and felt it merited a thread a few weeks back.

Of course in that case routine practice can be ignored. Trump is guilty thus everything he does is to delay or cheat and deep implications of guilt can be drawn from any attempt to stop the FBI and DOJ from doing whatever they want. Any decision that might appear favorable to him or his allies is only a procedural formality, an unfortunate bump in the road to inevitable legal defeat, and has no possible meaning beyond that.


Hopefully the DOJ will have their response filed in short order so we can get this latest delay tactic over and done with.

Trump's appeal was a delay tactic. Just like Graham's is a delay tactic.

That doesn't change the fact that Thomas' decision is procedural.

Even though I don't like Graham due to his telling Capitol Police to shoot the protestors on 1/6/2021, he's now serving as a useful tool that's making Democrats in Congress and the MSM angry.

Here's an excerpt from an article (one of many) describing how ANGRY Democrats are over Justice Thomas preventing Senator Graham's testimony.

"Hard to overstate how antidemocratic and delegitimizing this move is. The husband of a key insurrectionist blocks the testimony of a key witness in an election interference probe," activist Max Berger tweeted on Monday.

"Democrats should launch impeachment proceedings against Clarence Thomas. He's not fit to serve!"

It's medically proven that the more incidents of stress you can generate on/in a given group, the more their quality of life deteriorates. Anti-MAGA/Anti-AF Democrats must be removed from leadership roles in our society, by any means available. STRESSING THEM OUT is a sure-fire way to accomplish it. Justice Thomas and his wife Ginni Thomas (obviously) understand this VERY well.

Frustrated DEMOCRATS are INCREASINGLY going after Supreme Court Justice Clarence Thomas and his wife Ginni Thomas, simply because they are a Republican, Conservative, Mixed-Race couple. (Democrats show their true racism in situations like this)

As I said, procedural. The SCOTUS has refused to hear Graham's case, which means the lower court's decision stands. Graham is required to testify.
