Uhmmm.. why wouldn't a person want to toss out votes that were unconstitutional at their base? No matter who said it, it not only makes sense it's legal and the right thing to do.

It reminds me of someone I know who went to court 108-9 days after he was charged. He told his lawyer he wanted charges dropped, as he had been denied a speedy trial. His lawyer said "If that's what you're going to plead, I'm going to have to resign as your lawyer."
