Appeals Court Re-Affirms Stay On Biden Vaccine Mandate

I would think that there are many businesses breathing a sign of relief after this latest court ruling ! It would be different in my mind if you could take the vaccine and not have to worry about getting COVID but I think even the less informed know that is not the case. Full title is : “It Raises Serious Constitutional Concerns” — Appeals Court Re-Affirms Stay On Biden Vaccine Mandate

a U.S. appeals court upheld its decision to put on hold Joe Biden’s unconstitutional order for companies with 100 workers or more to demand COVID-19 vaccines, rejecting a challenge by his administration.

A three-member panel of the 5th U.S. Circuit Court of Appeals in New Orleans affirmed its ruling despite the Biden administration’s position that halting implementation of the vaccine mandate could lead to dozens or even hundreds of deaths. On Nov 6, the Fifth Circuit granted a temporary stay on enforcement of the federal mandate, one day after the rule was announced. In its reaffirmation Friday, the court said the mandate “exposes [petitioners] to severe financial risk” and “threatens to decimate their workforces (and business prospects).”

“The mandate is staggeringly overbroad,” the opinion said adding that the vaccine mandate “raises serious constitutional concerns” and “likely exceeds the federal government’s authority.”

“The mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers),” Circuit Court Judge Kurt Engelhardt wrote for the panel.

The mandate is not legal. It does not account for workers 100% remote who are no threat to a workplace and does not account for age groups and health of people. Someone young and healthy does not have the same threats to their health as someone old and morbidly obese. There is also no science to prove someone unvaccinated infects vaccinated. The CDC can't prove it in a court of law and they have stated that fact.

My first thought was when has this stopped this latest crop of crooks in D.C. from anything, but alas I will temper my reply with, "at least the judge agrees with you and a few of us Peons"!

Good. Some good news at least. Though I would like to see it banned indefinitely , not just to be put on hold.

The remote worker isn't an issue any longer. OSHA exempted them from the mandate. Now, everyone gets to decide whether to get vaccinated OR tested, no religious exemption necessary unless your employer has set their own set of guidelines. The down side is that employees who get tested every week have to pay for the testing themselves, which I don't think is going to fly.

The 5th Circuit Court was right about the mandate not taking account for everyone who has natural immunity, other health issues, and ages. Calling it a one sized fits all "sledgehammer".

From what I've read, the White House didn't want the 5th Circuit Court to make their ruling until the administration created a 'random judicial lottery" to select a court to merge ALL of the lawsuits together under one court, which is supposed to take place next week, but I don't think anyone truly believes that the selection is going to be random.

The good news is that Biden's Chief of Staff retweeted a tweet by a journalist calling OSHA a "work around" to sidestep the laws and get the mandate rules written to try and hold them up. The 5th Circuit Court judges already know this and mentioned it. It will be used against the Biden administration to prove their intent for trying to sidestep what they know is a legal process.

I am starting to think that if they can force 100% compliance on vaccines, then they feel they can declare "victory" over COVID. It will be in the same way that Iran has declared there are no gay Iranians, but still ... they will say they've "won" and try to claim it as a major accomplishment.

What are your theories on this? Are businesses more afraid of the media and cancel culture than their own employees and potential harm and lawsuits? It wouldn't surprise me.

If the courts shoot down the mandate, there's nothing federal agencies can do to enforce their rules. I'm curious to see if this goes to the Supreme Court and if they will reject hearing it so that lower federal courts can take the heat.

They're ability to try and declare victory over Covid was over the day they announced the booster shot.
