Yes necessarily. The ADA is a law. It’s specific in what it covers, what it doesn’t, and how. Blanket mask exemptions are not part of the law, and DoJ has specifically said they aren’t.


I've seen nowhere that you are supposed to produce papers to prove your exemption.


Because you aren’t required to. You are required to ask for reasonable accommodation, not just decide for yourself that it’s a reasonable accommodation to not wear a mask at all (which would be odd, since she was carrying a mask and evidently wore it in to the stadium) and declare victory. And should you do that anyway, the ADA still allows for denial of service due to threat to others.


But masks do make a marked difference even with mild asthma. I have exercise asthma. For most things, the mask doesn't bother me - light shopping trips, etc. I had to exercise in it for the first time a couple nights ago, and stuff that doesn't normally do more than make me breathe hard without the mask, flipped me into wheezing inside 10 minutes with the mask on. Because it's normally so mild, I didn't think it would be that big of a deal, but it was. Now I'm not going to go running to a doctor for a note just for that because most of the time, the mask isn't an issue. I'll see if I can control it with an inhaler first.


Neat.


But my point is that mask on v. mask off can be dramatic with asthma,


So is resisting arrest, to actual asthmatics.

In the speach given by the guy in the first video, he says she had told the cop she has asthma. I would think that tazing someone with Asthma would not be good myself. Whether that was a legitimate thing she told the cop, I have no clue, but they should probably never taze someone with asthma if the cops are informed that the person is asthmatic.

All that woman would have had to have done was ask the cops if she could social distance from somewhere else so she could watch, but it appears there was fault on both sides.

I was wearing one of the standard cloth ones. I've ordered us some made out of athletic material. They're supposed to be lighter weight, more breathable, and moisture wicking, but they haven't arrived yet. I was hoping we'd get them today. I might try a paper one and see how it does.

The problem I have is that I have a narrow face so they tend to fall off easily. I also sweat buckets, so they get soaked fast.

She wore her mask in because she was outside and when entering could not maintain proper social distance, but once in the bleachers, she could. That should have been obvious from the videos. According to Ohio mandates, you do not have to wear a mask outdoors if you can maintain proper social distancing which she was. The group she was with was her family group. Again, part of the Ohio mandate is that you do not have to wear a mask outdoors with your family group if proper social distance from other groups can be maintained, which it was.

Is it wrong of her to think that maybe she didn't have to wear her mask any more, especially if she had asthma?

Again, I wear a mask into my aerobics studio and out of it. I do not wear it to exercise as we can maintain proper distance on the floor while exercising. It used to be the same as tae kwon do, but as we have a harder time maintaining social distance there with less space and fuller classes, they switched to masks all the time, not just in and out and in the lobby area.

You are basically saying that anyone, any store security monkey, anybody with a badge, maybe even civilians with no brains can come and demand something and you' have to walk away and deal with it later' instead of standing your ground.

Nu-uh. I have asthma and I get hot flushes and panic attacks in shops quite often...and that is without a mask. I will not. EVER. wear a mask or be treated like cattle by a security monkey unless they are correct and I am wrong.
That's why it is important to stay informed. So you know your rights.

Did she? Can you point me to her statement saying that? Or are you maybe just deciding you know what she did and why and going from there? I feel like it’s probably the second one, but if you can answer the first one I’m all ears.

I know what was going on in her head.

She's been to several games without a mask, when hauled away she was complaining about it because those next to her did the same.

She said, how many times we all sat together without masks.

Did he issue a trespassing notice to her before she refused to leave? When trespassing the owner or representative if an ‘other’ needs to tell the officers they are no longer welcome. Then he issues a trespassing notice. Then if they refuse you arrest and it’s handled in court. She was following the law of the state and I predict she just got rich and he gets unemployed.

As a rule when a guy or gal with a gun and tazer and the law is backing them at that moment gives orders I listen to what they say and follow orders, because I have been tazed before and it wasnt fun dont really want to do it again, Ive also been shot at (not by the cops) and that was not fun either.

That said I had a LT come running up to me to yell at me for not wearing a mask inside an Open air plane hanger with nobody within a hundred feet till he ran up.

I laughed at him (I was in civillian status so he had less power than usual) then smiled big and said nobody was around me till you ran up, coughed and walked away.

I am sure someone will talk to me about that tomorrow, luckily most of the Senior NCO's think he is a gibbering moron.

ETA: That was not the time or place to argue it comply step outside and then ask for clarification etc.

I don't know and neither do you.

So at that point, it's your word against mine. You can have your feelz on the matter all you want, but if she didn't, then, as you say, would she bother to have a mask at all?

And the state government does not.

I've already pointed out that this whole mess is a mass of contradictory rules. And I freakin' will use personal examples because they are what I darn well know. I live in a welter of city, county, and suburban jurisdictions that lap and overlap with different requirements. And they all change from week to week, block to block and even business to business.

So if I fail to get one right, I deserve to be tasered and arrested for it? Does she? Resisting arrest aside, the cop in this case went from 0 to 60. If half the cops in the US did that right about now, we'd have at on of dead rioters every night.

Dude, I'm not the only assuming they know what's going on in her head. You seem to be in the "Muh rights, 'Murica!" camp as the only possible reason she'd do this. So don't lecture me on assumptions. There are plenty of reasons I can think of for why, including that one, and none of them come out of the video.

After you are served with a notice OR the OWNER warns you UNLESS OTHERWISE POSTED. there were no "no trespassing" signs there tj hooker.

I've not tried the fabric masks myself and I've only used the disposables. My wife made them at first for her to use while shopping and working.

Me, I've got a large head, so the disposables seem good for me.


I've been more or less sheltered since the start as I'm at extremely high risk, and I had already been working from home for years in our business. My wife is our public face, so she has to use the masks and the sanitizer when she's out.

I get whey people are upset over mandates, any mandates, but I'm not big on the idea of not wearing masks just to get attention or be a thorn in peoples sides. I do know there are alternatives and the disposables do not block breathing, unless of course it is psychosomatic. I get that too. Some people panic, but it's up to them to find workarounds.
