Police apprehended Cody Hansen, 35, in his Spokane, Washington home after receiving an anonymous tip, local news station Q13 Fox reported. He was charged with second-degree assault

What is Second Degree Assault?

The elements of assault vary from state to state, but degrees of assault can be first degree, second degree, or third degree.

First Degree Assault: the intentional causing of serious bodily harm or serious bodily injury to another person with a deadly weapon.
Second Degree Assault: when someone knowingly causes serious bodily injury, knowingly causes injury with a deadly weapon, or recklessly causes serious physical injury to another.
Third Degree Assault: when a defendant recklessly causes serious bodily injury or recklessly causes injury with a deadly weapon.

It’s important to note that the difference between the assault degrees depends on the intent and state of mind of the defendant. The more intentional the act, the more serious the charges, and the more severe the punishment.


My question here for any who know about these laws is simple. Knowingly punching an old man with a cane who is sitting down and not able to defend himself considered only a second degree assault. It seems to me that this guy thought about it for a while and then sought out the veteran pummeling him in the face and head then, as seen by his self congratulatory shrug, was happy with himself.

Why is the premeditated assault on an old person with bare knuckle fists not considered assault with deadly weapons. Why not premeditated attempted murder. The old man was left unconscious and might have been dead for all the assaulter knew as he walked away triumphantly.

When charges are brought against someone the prosecution is tasked with proving the charges in court. The burden of proof varies by state so maybe this attorney only charged the man with what he could prove according to state laws.

They can also change the charges later as evidence is gathered.

When the prosecution in the George Floyd case raised the charges to murder two they made a huge mistake in my opinion. They could have cranked up the charges as evidence was gathered but now they have a much more difficult time ahead to meet the burden of proof.

This prosecutor might be playing it safe.

LIkely. Even if guilty as charged this fool can go away for a good number of years. Chances are also that a jury, after seeing this footage and the old man in court could decide to press for further charges, or maybe even the Grand Jury that will first decide what charges could be levied.

It's just a ridiculous scenario playing out in this country right now. It simultaneously shows what is good about America and what is bad about it.

Alleged "Freedom Fighters" refusing to wear masks.
Alleged "Virus Fighters" asking people to wear masks.
Plenty of stories from either side now where either group totally and fully acts like immature and selfish fools.

To be clear it sounds like the thug in the OP is neither a Freedom or Virus type but rather just another low life criminal, "Hansen was also wanted on a drug charge and probation violation in Alaska."

Anyway, IMO, the current divided status is the result of using half-measures and the total failure at the highest levels of leadership, both Dem and Rep, in responding to COVID .

The victim, who is reportedly partially disabled and could be seen with a walking aide and dog in the footage, told officers he made a comment to Hansen’s girlfriend, who was not wearing a protective face-covering in public. He said Hansen later returned and assaulted him.


Wow wonder what he said to the guys girlfriend. Wonder why People think they need to police others, they are safe inside their masks.

He lifted his hand to his face defiantly was not unconscious. Pretty vicious attack for sure.
You see that little dog go after the guy!

looks like he gonna get himself a fancy new set or 2 of the orange jump suits, one from the state of Alaska and one from Washington, if he doesn't run again.

but that's ok, these kinda people just can't control themselves, if he runs he'll commit some other kinda crime, get caught and then either he'll run one more time or wind up in prison for a even longer time. he appears to stupid to realize that the more sh@@ he does and runs the more time he's gonna get.

better yet maybe he'll try that sh@@ he did on somebody that his is own size or bigger or someone that is packin and they bust his melon.

doesn't matter what the old man said, he just said something. plus masks aren't suppose stop you from catching covid, their suppose to slow the spread.

People keep making it their business to decide what others do. The guy doing the beating had a mask, if the Girl Friend didn't most likely there is a reason, more and more people think they should be Nazis and watch their neighbors and open their mouths.
Should he have beat the guy, NO but neither should he have said anything to the Woman.

still doesn't matter, he has the right to say any thing so long as it's not like saying fire in a movie theater. he didn't touch either one of them. he only said something. the only thing the two could do legally is say f--- you back.

what if the hotel has a strict policy of mask wearing in the common public areas, which is their right it's private property, and the old man told them that?

what if the hotel kicked them out for the dispute?

Washington state also has a state wide mandate that masks be worn in public places, what if during the dispute the man and his girlfriend showed their asses, the hotel kicked them out because she refused to wear a mask in the common public areas?

thing is other than the dispute and attack the only thing known is the azzhole returned by himself and that after the beating he left the hotel and his girlfriend picked him up out side. it was a planned retaliation not a heat of the moment reaction.

ture, but as i said we don't know what was said or if she could or couldn't, what hotel policy is, what the old man said or why they left. what we do know is they left and he came back alone to attack the old man and she was his getaway driver.

Well we don't actually know that either do we? Maybe she was angry her Boyfriend attacked the guy and she left him. A lot of speculation just to offset what I am saying which is no one seems to want to MTOB suddenly.

I agree regardless of what the stupid laws say, a fist to the head can easily be a deadly weapon, and regardless of the outcome.
