A bank account -- even under on spouse's name -- is communal property in a marriage unless otherwise stated in a prenuptial agreement or something
similar. If Summer Worden (McLain's estranged wife) wanted McLain to no longer have legal access to that account, then she should have closed it or
took some other measure to protect it.
Granted, the two are separated, so that might be considered a factor, but just a separation doesn't
necessarily make it illegal for one spouse
to look at the bank account of another spouse. Other steps would often need to be taken to keep one spouse from the bank account of another, even in
a separation.
Summer Worden is certainly entitled to make the accusation that McLain did wrong, and because she made an accusation it should be investigated, but
Worden's accusation may not have a legal leg to stand on and the investigation may go nowhere.
