What Schiff is saying here is total BS. Harry Truman? He was president 1945 – 1953, The National Emergencies Act was enacted 1976. The law didn't exist when Truman was president.

The power to declare a national emergency is to protect the Constitution
That has always been a power of the Executive Branch of the US government
With the amount of insurrection in the US today I can see that happening
Sanctuary cities
Allowing non-citizens to vote
So on and so forth
All these things are a direct threat to the Constitution
Easy to see not many informed US citizens commenting on this thread.

An excellent discussion here, and thanks for the information that everyone's brought to the table. It pretty much matches what I found out.

USA Today had a headline that I thought was pretty much to the point: Trump COULD declare a state of emergency but that doesn't mean that Congress will release any funds for the wall.

I think the work around being that if Trump calls for a state of emergency, he can tap and use the military funding that was passed in that massive omnibus bill.

That's the argument I'm hearing.

People are looking at the small stuff. The Constitution contains some big powers of the President:

he may, on extraordinary occasions, convene both Houses, or either of them, and in case of disagreement between them, with respect to the time of adjournment, he may adjourn them to such time as he shall think proper

The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.

he shall take care that the laws be faithfully executed

That third part I pointed out is how he can make that declaration of emergency. Sanctuary cities violate federal laws.

I believe in this case he could also move apprpriated funds from one specific area to anther, which is pretty much a felony in any other instance.

I have seen a discussion about the courts being used to block it, and that's feasible (if you remember the immigration debacle.) One thing that a lawsuit would do is allow breathing room for Congress to decide what they're going to do about this sudden move.

So... if I read the situation correctly, the likely scenario goes from "emergency declaration" to "immediate lawsuit" (which will happen right after he signs the executive order) and then... it goes into the dogfight.

I think that this will end up in the courts and the cases will be important in deciding the limits of future powers.

I do wonder, as I don't know, what congress will be able to do regarding Trumps military direction while under the emergency status.
