Prisoners transferred to psychiatric hospitals become restricted patients, not prisoners. Hospitals are very picky about not breaching the patient's rights to confidentiality. She might not have been eligible for s 37/41 (sent straight to hospital instead of prison) at the time of sentencing, but she could easily have been s 47/49 (transferred from prison to hospital) at a later date if she started to act up.

Anyway, it appears to be a moot point for educational purposes only as Sabina was apparently released on parole in 2011, which suggests she stayed within the prison system.
