In its 1997 decision in the case, the Supreme Court ruled that the provision of the Brady Act that compelled state and local law enforcement officials to perform the background checks was unconstitutional on 10th amendment grounds.
However, the overall Brady statute was upheld and state and local law enforcement officials remained free to conduct background checks if they so chose.
Um. No. The background checks required by the Brady Act were not upheld.
Unconstitutional but gets upheld anyway.

and it's not going to happen. i doubt it will pass the house.
the congress people know that if they try to pass a gun ban law right now that hell will be raised.
to many people buying guns now. that sends a signal to them.
The SCOTUS saying it's Constitutional doesn't make it so.

It makes it the law of the land. Like it or not. Agree with it or not. According to the SCOTUS, some gun laws are constitutional (and some are not). According to you, none are. Guess who wins?
