An British-born man has initiated legal action against the Australian surgeons and medical center that gave him a sex change operation in 1988. Alan Finch claims that he was misdiagnosed and that his operation did not change his gender because it only rearranged his flesh. Finch had his hormone induced breasts removed and his now living as a man without a penis. He runs a support group for the gender-dysphoric.

Man to sue over sex-change op

28.10.2004
By GREG ANSLEY

CANBERRA -
A Melbourne man who regrets becoming a woman has launched legal action against the surgeons and medical centre that gave him a sex-change operation.

A County Court judge is considering whether to extend a six-year limit on litigation to allow British-born Alan Finch to sue Monash Medical Centre's gender dysphoria clinic over the removal of his testicles and penis and the construction of an artificial vagina in 1988.

Finch, now an anti-sex change activist who took his campaign public on national television last year, claims that, far from being a man trapped in the wrong body, he had in fact been clinically described as displaying above-average masculinity before the operation.

The neuropsychological report made as part of the process to determine his suitability for a sex change found he did not display female gender identity but instead escaped into fantasy. The findings were not made known to Finch until eight years after he became a woman.

Finch, who runs a support group called the Gender Identity Awareness Association, claims he was misdiagnosed. He has had his hormone-induced breasts removed and again lives as a man, although without a penis.

Is the sex change industry simply a vile conspiracy to separate the gender-dyphoric from their cash? Personally, I think the changes rendered by sexual-reassignment surgery is so superficial, though not inconsequential, as to create an individual who does not fit into normal society and that intense psychotherapy to help such individuals cope with their problems rather than simply "sculpting flesh" to produce non-functional sex characteristics.

Not to troll or anything, but what's the point of having yourself mutilated like that? You're genetically male or genetically female, and no surgery can change that.

You try to change yourself into a woman, I'll still refer to you as a man, because that's what you are chromosomally.

I thought anyone having the desire to change their sex had to go thru years of counseling? I saw a case on a tv show of someone who went back and forth between different sexes, couldnt make up his/her mind

I wonder just how "useful" their equipment becomes after these changes

Misdiagnsed or not, the man himself made the decision to have sex replacement surgery. He was aware of the consequences, otherwise he would have just stayed the way he was.

well, now he has the worst of both worlds. He's both a man and a woman.

I know I'd hate to be a hermaphrodite....

He's still male. Like I said in a previous post, it's genetics.

Well, I don't see the point for a law sue because he allowed the surgeons to do the sex change and he did consent on it.

For a man to become a women is easier, than for a women to become a man.

Because most plastic surgeons not matter how good they are can not recreated what has never been down there to begin with.

In a case of a man, after removing the sexual organ is enough room to created a female genital area, because the cavity is there.

In a women is very difficult and the results are not what most people desire, after all is nothing down there to work with anyway.

I think that the man in question has not case at all.

Finch underwent the operation at the age of 21 because of what he now describes as an identity crisis. But he told ABC TV's Australian Story last year that the results had been disastrous, leading him into an illegal marriage, another failed relationship with a man, and finally a relationship with a woman who had urged him to change back to a male.

*SNIP*International research indicates that up to 20 per cent of sex-change patients regret the operation.

A 2001 report by the Victorian Psychiatrist's Office reportedly expressed some concerns at the Monash Centre's procedures, and a confidential review was ordered last November.

This looks like a sad case indeed.

Did the clinic actually do the required amount of therapy? An identity crisis need not culminate in a sex change operation. Many 21 years olds are really not mature enough to make these decisions, I'm afraid.

He tried relationships with men and women and could not seem to fit in with either after the operations.

If the clinic is shrirking its responsibility, it need to be brought to the public attention before more people are disfigured.

Man that would take one heck of a person to get himself WACKED like that. I agree with the others in that he is the one who made the decision without a gun at his head. I guess he just figured that if he did'nt like it it would grow back. Wrong! Now if he went around tripping over it that would be a different story but I still say he does'nt have a ____ to stand on!

Again, another example of someone refusing to blame himself for his own actions and trying to make out hes a victim and then looking to sue the easiest target available, my only surprise was that this is not in the US.

I do suspect that these doctors make two primary mistakes: On the one hand, they go along with the APA, which is union, industry standard, and political ideologue all wrapped into one. This singular entity is very much interested in profit and the mere perpetuation of itself (I am not saying that there aren't many insightful, caring, genuine, non-arrogant psychologists coming up with good ideas, just that the system is tainted).

On the other hand, these doctors are in essence quite biased, as they are bound by the same rigid self-identity as everyone else. They have a desire to match object with subject, and these things didn't necessarily go together in the first place. Plus, these operations are vaingloriously considered progressive and compassionate by their orchestrators.

If society allowed men and women to be as they are, such an operation would be nonexistent, as it would have no use. It is a sad thing when someone has to suppress very real aspects of their personality, aspects which will eventually swell like a veritable Prometheus rising, as a raging fire which will not be contained. The problem is, if somebody denies key personality components, these components are very undeveloped, feared, etc., causing the individual to either withdraw from society or lash out against it, among other serious consequences. It places the individual in a downward spiral, as all emotions and logic available are necessary to have a satisfying direction (upward spiral) in one's life. They are perpetually disconnected from the self. I think in a world like we might luckily have, say, 20 years from now or actually, possibly much sooner, this individual would never have even considered such a thing.

Men and women are different, and, "Vive la difference." However, the similar needs for direction, emotional support, communication, emotional and logical expression, friendship bonds and lovers, the innate desire to "be," etc., etc., etc., are far too numerous to mention. It makes one wonder, are those in support of rigid gender roles secretly fearing that both men and women are, deep down, identical, and that is why they think people must be programmed into different roles. Don't get me wrong, the difference creates both a joy and synergy, but people would naturally seek out complementary spirits in a world of free expression, and as such, this process would not be lost.

I do apologize if anybody thinks it too much to display the former opinion, as it is only indirectly related to the OP, but still VERY much related nonetheless. I have a tendency to operate this way on these boards, as we are all here to both learn and have our piece in the societal dialogue. Millions of heads are better than one.
