Unfortunately I'm mobile and don't have the time to find the articles I found last night but some of what I was able to find was: she appealed her termination and it was sent to an arbitrator; the arbitrator upheld the termination (but I couldn't find out any info about the arbitrator other than "third party arbitrator); BPD hit her with something like 13 separate violations, and all but two of them were upheld; the male officer won defamation suits (plural) against both Horne and her attorney; the male officer now has been indicted by the Feds for civil rights violations relating to another arrest, and has (I think) two or three allegations of excessive force;

I promise I'm not trying to get an argument going. I just had a minute to throw all that back out there so I did. Take from it what you will.

Former Buffalo Police Officer, Cariol Horne is fighting for her pension since she was fired after 19 years on the force, over an incident in 2006 when she stopped a fellow officer from choking a handcuffed suspect.

Horne had received a call that Officer Gregory Kwiatkowski was at the scene of a domestic dispute and in need of assistance. When she arrived, she witnessed Kwiatkowski violently punching the handcuffed suspect in the face.

Is this SOP in most depts?

n almost every single video we see, there are other officers present and allowing it to happen. Sadly, with departments across the nation upholding their reputation of vilifying anyone who dares to cross the thin blue line, it’s no wonder there is such a shortage of police willing to speak out against the atrocities we have been witnessing.

While many police may choose this line of work because they want to be “heroic,” Horne is a true hero- and she does not regret her actions. Nobody ever said being a hero is easy.

The system is broken and I don't see it changing with the militarization of Law enforcement.

I'm from the Rochester area and can vouch that this hasn't been any news stories whatsoever. If this is true then I have very little faith in NY cops anymore. We are probably on the most "oppressed" states. Our laws are ridiculous and everyone plays the "good old boys" routine around here. I'm not surprised, but at the same time, I'm a little shocked. Our police forces are generally "good" in upstate NY. If this was made mainstream I have no doubt that people from Rochester would be seriously outraged considering Roc's mayor Lovely Warren made a public statement against the police force of STL, what with Mike Brown.

I don't know what this implies for Upstate but I do know that if this crap moves farther east, these pigs will be in a lot of trouble. The good old boys from this part of the state love their guns and their land.

The police can keep up the nonsense but they are digging their own grave, as the says goes.

Bizzaro world, and its likely going to get more nutty. But realistically how many of such cases happen? Though I believe it, and I have seen it, not among cops as I stay always from all that, but in pretty much all the jobs I had there was always something like this. I have been saying for a long time in this world no good deed goes unpunished, so if you want to do a good deed you must disguise it as a bad deed, and even then its a headache.

In all its best we think of this on a case by case basis, you know one bad apple will ruin the whole bunch that is true in everything. But its still one case and does necessarily speak for all police, though now a days it seems to be a free for all on this thing by both and all sides. So who knows what will happen, but its likely more of the same, its generally how these things tend to go, one slight leads to another and so on, and so on, etc, and even if you know there is little you can do about it, its practically nature taking its course.

The officer she says she kept from choking a suspect has been arrested recently WHILE awaiting further proceedings related to civil rights violations and the use of excessive force Buffalo News may 20 2016 .

Gregory Kwiatkowski, a retired lieutenant, was arrested last month in Montague, a small rural community southwest of Watertown, and charged with driving while intoxicated and refusing to take a breathalyzer test.

Kwiatkowski and two other officers, Raymond Krug and Joseph Wendel, are defendants in a criminal prosecution charging them with violating the civil rights of four teenagers who were 17 and 18 at the time of the incident on Treehaven Road in Buffalo.All three officers are accused of using excessive force, and all three have pleaded not guilty.
