Freedom Watch founder and attorney Larry Klayman, right, says it's unlikely President Barack Obama is a U.S. citizen. Klayman doesn't expect the claim to influence judges considering his anti-mass surveillance lawsuit.

Yes, this is actually happening.

Conservative legal activist Larry Klayman has submitted what he calls a “deportation petition” against President Barack Obama, asking authorities to begin the process of removing Obama from the country.

Klayman won the first and thus-far only federal court ruling against the National Security Agency’s bulk collection of U.S. phone records in December 2013 and is defending that win before a panel of the U.S. Court of Appeals for the D.C. Circuit on Nov. 4.

Then followed a technical description of the problem for Obama;

A young woman giving birth in a foreign country to a child whose father was not an American citizen (and was himself deported) did not have the legal capacity to pass along American citizenship to such child, a report for the Western Journalism Center confirmed.

“When enacted in 1952, section 301 (of federal immigration laws at the time) required a U.S. citizen married to an alien to have been physically present in the United States for 10 years, including five after reaching the age of fourteen, to transmit citizenship to foreign-born children. The 10-year transmission requirement remained in effect from 12:01 a.m. EDT December 24, 1952, through midnight November 13, 1986, and still is applicable to persons born during that period,” the Western Journalism Center’s report explained.

Ann Dunham was only 18 years old upon Barack Hussian Obama’s birth on August 4, 1961. Her own date of birth in Wichita, Kansas, was November 29, 1942. She turned 14 on November 29, 1956. Therefore in contrast to the law’s requirement, she had lived only 4 1/2 years from her 14th birthday up until Barack Hussein Obama’s birth on August 4, 1961 – and apparently not all of those years actually within the United States.

Thus because of the requirement to reside in the United States continuously for five years after becoming 14 and a total of 10 years in the United States overall, Barack Hussein Obama could not acquire U.S. citizenship through his mother Ann Dunham. At the very least, he would have had to apply at some point for naturalization.

When people do this kind of thing they make a mockery of the legal system. They know it isn't going anywhere, unless self delusional, so whats the point?

I wasn't that familiar with Klayman, but after reading his bio I realize how spot on I was with my initial assessment. The man is a legal troll, or troll lawyer.

He has made frivolous suits against dozens of people and while he has won a few, (against the Clinton administration for spying, against the Obama administration for spying) they seem to more symbolic in nature than anything else. In the latter, they did rule in his favour but put an injunction on the decision pending a higher court appeal.

An injunction is basically a pause, hold, limbo, etc. So they basically said, "ok, well you have a point, here's your bread for the day."

The guy even sued his own mother:

In 1998, Klayman sued his mother for $50,000, seeking reimbursement for medical care provided to his maternal grandmother. After Klayman's brother told Newsweek magazine of the lawsuit, Klayman alleged that the Clinton White House was responsible for the magazine acquiring the information.[34]

Seems to have no shame at all.

He has sued Esquire, Facebook, and even sued to prevent the ground zero mosque from being built. When the opposing council said in their motion to dismiss:

Klayman is an "infamous publicity hound" and wrote that Forras "trades in his well deserved laurels for fifteen minutes of fame as a nationally recognized bigot."

He sued them for defamation.

No shame at all. He has been lifetime banned from practising law in two judges courtrooms, and also censured by the bar association.

He reminds me of the inmates you read about, filing One Frivolous Law Suit after another and just backing up the court system.
It's not going to go anywhere, ( and believe me, I wish it would ) and I'm sure it'll be thrown out of court, don't you think?

Another Funny thing is how no one has come forward with, "He was soooo shy..." or "What a great dancer..." from any of his college days. Clinton's devotees certainly seemed to have long memories..

What difference at this point does it make? He's already done his best to flush the country down the crapper and divide it as much as possible.

Anybody that thinks Obama is not an American citizen is an idiot. He just another ignorant birther who thinks Obama was born in another country after he loses this case he should be forced to pay all the court fees instead of them being passed along to the tax payer.

From what I read at USCIS.gov he's right about the 10 year law. No, I'm not going to do your leg work for you, do it yourself or anyone else who wants to read it. I did it for my own reason's and I only wish this would move forward, I know it won't.

He thinks Obama was born in a foreign country he has done very little homework. Obama was born in Hawaii that makes him a citizen so the ten year law is irrelevant because it only applies to children born outside this nation. From your link.

Changing names does not change citizenship. Yes he changed his name so what he is still an American citizen. You birthers are good for a laugh though.

I realize you are a strong supporter of just about everything I see wrong in this presidency. There is always an excuse for the man who promised hope and change... The man that many believed would be different than the same old crony capitalism that has been going on probably since Ike. Instead we got more of the police state and more being declared some kind of enemy of the state and the country is more racially divided than it has been since Martin Luther King... At least it appears that way to me. So I don’t hate them per definition but I condemn them because they are the worst kind of racialists; they are elitist who do not believe in the constitution or the way the government is supposed to work. Instead as with any elitist it is rule by decree usually on a Friday after everyone has gone home.. so to summarize; I do not care who Clinton slept with or what all the Bushes did to destroy the constitution or how Regan according to some was such a senile dirt bag or even that Kennedy was drugged out between his affairs ..
