DC District Court Overturns Ban on Right to Carry Firearms in Palmer v. DC

Today, July 26, 2014, the District Court of the District of Columbia has overturned the DC's ban on the carrying of firearms in public. An excerpt from the case, Palmer, v. DC, follows and the full opinion can be downloaded from the link below this blog entry. Source

In light of Heller, McDonald, and their progeny, there is no longer any basis on which this Court can conclude that the District of Columbia's total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny. Therefore, the Court finds that the District of Columbia's complete ban on the carrying of handguns in public is unconstitutional. Accordingly . . . the Court grants Plaintiffs' motion for summary judgment and enjoins Defendants from enforcing the home limitations of D.C. Code § 7-2502.02(a)(4) and enforcing D.C. Code § 22-4504(a) unless and until such time as the District of Columbia adopts a licensing mechanism consistent with constitutional standards enabling people to exercise their Second Amendment right to bear arms. Furthermore, this injunction prohibits the District from completely banning the carrying of handguns in public for self-defense by otherwise qualified non-residents based solely on the fact that they are not residents of the District.

Its always hard for them to ban open or concealed carry because the police do it on or off duty and so do others that transport money to banks or act as bodyguards, security, whatever. So they say its unconstitutional to ban carrying firearms but just you go there and try it. Or anywhere for that matter.

While I support it simply because it is constitutional, I do not care for open carry.
Open carry removes some tools from your arsenal of possibilities.
I prefer to just conceal carry.
I've never had the cops called on me, probably because I am a grey man.

It's about time...common sense prevails.

Now we need to get rid of NY City's "Stop and Frisk".
That's another CLEARLY UNCONSTITUTIONAL LAW.

Thanks to the sane judges who exhibited such fine
reading skills when it came to the Bill of Rights. It
seems we have lawmakers who need to go back to
school for remedial reading classes

I have to tell you I would go crazy being stopped for no reason and be frisked, I get belligerent when the cops have a stop and check your paperwork at a checkpoint on a busy street for no reason. I don't even fly any more because of the TSA crap.

The concealed pistol is only there to get me back to the car where the rifle waits.
