Women faces wiretapping charges after allegedly recording her arrest

The Fraternal Order of Police with 325,000 members would never allow any such garbage used against one of their members. They are one of the few private lobbies that contribute to both democrats and republicans coffers and their influence is deep. The power of the union is based on it contributions.

Basically anyone who tries something like this will be assaulted by both sides of the media with loud-extremely loud dissent that the individual was seeking to waste the officers time and prevent him from fulfilling his duties of protecting the public. They can beat the crap out of you and no one will give a damn about it because you instigated an encounter that was obliviously self serving.

I sure even the ACLU will hang you out to dry for something like that.

IF you´ve done NOTHING wrong, then i say go for it.
Use cameras/audiorecorders. They CANT do anything
as long as you inform them and have it displayed on the
vehicle.

I actually use it when i get phonecalls with someone
who whants to get into a contract..
I say:
"This conversation will be recorded, is that ok with you"
Most of the time they say yes, but many times they just
hang up...

In defense of the plaintiff, recorded evidence should always be usable to protect against fraudulent charges.
In stories like this, any sensible judge who stands by the good law would throw out any such ludicrous charges like " illegal wiretapping"...
Preparing to defend yourself in the court of law is NOT A CRIME.

To dispel a charge against or accusation against is acceptable use of recording evidence.

You would think, when it had become obvious that the state had more rights then the
people wouldn't the majority become concerned of such unjust inequality? Well not here in
the USA. The people here are more concerned about what time that football game is on
or watching American Idol or whatever other psychobabble they can get their minimal
intellect around! This is the main reason why America will never revolt against the
fascist tyranny that has consumed it! The main thing that needs to happen to bring
about the change that is so desperately needed would be the utter destruction of all
smart phones, television and mind altering prescription drugs!
I believe our average I.Q. would jump 30 points and we would bring an end to
the injustice that is destroying our society!

Perhaps, you misunderstood me. I'm not saying you are provoking an encounter-I'm saying that is how it will be perceived by the media. The media-both national and local can be unforgivably vindictive when they want to be. Ruining someones life is just another day at the office-believe me-I have been there and I know.

You are going to get crucified by the media and the media could care less about details, your motivation or if you are in the right or not.

Lets say you are informing a patrol officer that you are recording everything he does-and a child dies across town-a child that might have been saved if the officer was not tied down by your actions. Do you know who the media will blame-their going to blame YOU. Then systematically ruin your life.

That is why I tell people not to engaging in preconceived behavior when dealing with the police. Because YOU are going to get blamed every single time.

I have not heard anything else about this case. I'm not familiar with accessing Massachusetts public records or I could efficiently look up the case.

I am curious to know if the state has formally charged the women for wiretapping.

A federal appeals court is ruling that the public has the right to film cops in public and reinstated a lawsuit against a local New Hampshire police department brought by a woman arrested for filming a traffic stop.

In the latest decision, the First US Circuit Court of Appeals ruled that Gericke "was exercising a clearly established First Amendment right when she attempted to film the traffic stop in the absence of a police order to stop filming or leave the area." The decision allows her lawsuit against the department to proceed.

Now police will just tell people to stop and leave. At least it's not an immediate arrest.

I don't think the 'stop' order is reasonable. Are the police afraid of what will be seen, probably in some cases.

Any updates on this story? I'm not a resident of Massachusetts so I have really been paying attention to this case.

In light of recent events, I have to say I am happy this has not become a police bashing thread. The police have a difficult job. In my opinion departments all over the US are plagued with poor leadership. This is true of a lot of public service industries.

I am a concerned citizen and a student of history and well aware of the dangers of the 'if you have nothing to hide then you should not be worried' and 'See something, say something. Report all suspicious activities to the authorities.' mindset that is being pushed across the nation.

People would spin the gruesome aspect of law enforcement, out of context for their own agendas. As much as uploading everything a law enforcement officer sees and does on the free web sounds great, in this age of information and propaganda it won't go far.
