I doubt they have any real evidence against him.

Much better to keep him "out there" as some shadowy figure and every time they want to do something unconscionable, like invade faluja, they tell every one that "Zaqarwi is in Faluja".
This then soothes our troubled consciences in regard to what we are doing there.
