There are gases that are odorless, tasteless, and colorless. They are not able to be detected before it is too late.

As for the legal problems, well there could be worse, they could be sued for groping lol or loosing a whole plane.

Or they could have everyone on the plane to wear a locking explosive collar that are all numbered, the pilot trigers the number of the highjackers collar and "boom", problem solved......

Your correct, I wish that they would have two different air lines one that is secure and one that is not. Guess which ones would have to worry about the terrorist.
